From 2013 to 2017,the average annual growth rate of China's high-tech manufacturing industry was 11.7%,while China's high-tech product export volume in2017 was about 7832.31 billion yuan,accounting for 34.6% of the total export volume.It can be seen that during the rapid development of China's high-tech industry,the export of high-tech products has a huge impact on China's foreign trade.However,in the current economic situation,both the globalization and unilateral trade protectionism are co-existing.The high-growth exports on high-tech products of China have become a threat to many enterprises and local industries in developed countries.Developed countries relying on their technological advantages,began to use various trade barriers to hinder the entry of China's high-tech products,so that safeguard their own global interests.Compared with other trade barriers,the trade barriers built by using the protection of patent property rights are more hidden and effective,which are continuously expanded and consolidated by developed countries through patent system and trade rules.The protection of patent property rights are being used as the patent barrier set by developed countries to developing countries.Therefore,this paper studies the patent barriers faced by China high-tech products export and explore China's strategies to deal with the patent barriers,which can help high-tech enterprises in China to better deal with the patent barriers.This paper starts with the concepts of patent,patent system and patent barriers,then sort out the main patent barriers which China is facing and their ways to affect the export of China high-tech products.Meantime,by analyzing the U.S."337 survey",one of the most influential patent barriers for China is found that the patent barriers of the USA have a great inhibitory effect on the export of China high-tech products.Through the econometric analysis with EViews8.0,we can get the influencing factors of patent barriers to the export of China high-tech products.The results show that the export of high-tech products is closely related to China's overall economic development and foreign trade environment.More patents filed by foreign applicants in China will inhibit the export of China high-tech products,With the increased patents filed by USA residents,the inhibition impact to China high-tech export has been significantly enhanced.By importing more high-tech products,Chinese enterprises can obtain more technology spillover,which is conducive to the development of independent intellectual property rights,so that bypass the patent barriers of foreign enterprises,and expand the proportion and the scale of high-tech product export.Finally,this paper analyzes the main reasons why China high-tech exports are vulnerable to patentbarriers.Including the lack of proprietary patent rights in China;The quality of the patent is not high;Weak awareness of patent protection;Inadequate ability to respond to overseas litigation;Not familiar with foreign patent laws and regulations;The enterprise patent property right strategy lacks,as well as the domestic patent protection system is not perfect and so on.In view of these problems,this paper puts forward the corresponding strategic suggestions.Including participating in the construction of international patent rules and international standards;enhance the innovation of the independent patent;Popularizing the culture construction of intellectual property protection;developing patent service system and enhancing the overseas litigation ability of enterprises;establishing and developing a patent strategy for enterprises and improve the patent protection system.So that it could help Chinese enterprises to deal with patent barriers more actively and effectively.
