Maritime transportation is one of the major transportation modes in the international logistics.Bill(s)of Lading,as the most important document of maritime transportation,bearing the three functions of document of title,cargo receipt and evidence of the Contract of Carriage,is being called the foundation of the international trade.But the Carriers are facing huge risks during the circulation of the Bill(s)of Lading because of the loopholes in the risk management of the companies,the defect of the Bill(s)of Lading circulation mechanism,the imperfect system of laws,regulations and international conventions,and the challenge from the technology development.With the subject of studying the risks that the Carriers are facing during the circulating of the Bill(s)of Lading,taking S Company as the research object,using the methods of literature indexing,case study,experience summarization,comparative analysis and normative analysis,combining the theory study with real practice,this paper has explained the Bill(s)of Lading,basic concepts of risk and their related theories,has deeply analyzed the process of international trading and the circulating of Bill(s)of Lading including it's issuance,transferring and delivery,and carefully sorted out the related business and risk management processes.Then from the sides of both micro level of enterprise business practice and risk management and the macro level of outside economic and legal environment,the author has further studied the enterprise risk preference by identifying the risk and its different types after analyzed the resources of risks and the factors and events that are affecting the risks of the Carriers are facing to.Finally the author has clarified the risk management strategy of the Carriers and proposed specific measures to avoid and prevent such risks.Standardizing operational procedures,clarifying the allocation of responsibilities,optimizing staffing,and accelerating information construction are proposed to avoid risks and insurance structures optimizing is proposed to transfer the risks.After clarified the internal defect of the circulating system of the Bill(s)of Lading,the author has analyzed the different remedy mechanism under different rules compared the Maritime Law of China and the four international maritime conventions(the Hague Rules,Hague Visby Rules,Hamburg Rules and Rotterdam Rules),then the best selection of proper legal system and mechanism are indicated to avoid the risks.This paper applies the theory of risk management to the carrier's Bill(s)of Lading risk management,and comprehensively controls the carrier's risk in the bill of lading instead of staying at the micro-operation level,practical solutions are provided while new solutions and ideas and proposed.It provides a template for minimizing the Carrier's risk in the circulating of Bill(s)of Lading and protecting the interests of the Carrier in a depressed economic environment.
