Research On Disciplinary Punishment Of China Football Association Based On "Standardization Of Sentencing"

Sports discipline punishment is a punishment decision made by various sports organizations on the violation of rules and regulations of the perpetrators according to the association's articles of association and disciplinary standards.The "Chinese Football Association Discipline Code" is an important basis for the Chinese Football Association to punish violations of rules and regulations.It is used to regulate players,officials,clubs,and competition areas,and plays an important role in ensuring the normal order of football activities.The objective and fairness of disciplinary punishment directly affects the healthy development of the entire football movement.Judging from the implementation of the disciplinary punishment of the Chinese Football Association at this stage,remarkable results have been achieved,but there are still some areas for improvement.This paper adopts literature data method,logic analysis method,case analysis method and statistical analysis method as the main research methods.Through the statistical analysis of the discipline rules and penalty decisions of the Chinese Football Association from 2014 to 2018,focusing on the current situation of disciplinary punishments of the Chinese Football Association,and analyzing its problems in disciplinary punishment.Drawing on the successful experience of China's standardized reform of sentencing,combined with its provisions on sentencing circumstances,sentencing principles,and methods and steps of sentencing,providing ideas and countermeasures for the standardized development of disciplinary punishment of the Chinese Football Association,taking care to suit the punishment to the offence,ensuring the balance of punishment.In order to improve the discipline of Chinese football matches and promote the development of Chinese football.The main conclusions from the research are as follows:(1)The Chinese Football Association has revised and updated the "China Football Association Discipline Guidelines" five times in 2014-2018.As regards its new content each year,the penalties are gradually refined and the provisions on the working procedures of the Disciplinary Committee are added;For the content of the deletion and modification,the penalties are gradually increasing,which is reflected in the provisions on the fines and the number of suspensions.However,there are still problems such as the scope of punishment is too broad and the punishment plot is not detailed enough.(2)The punishment decisions issued by the Chinese Football Association from 2014 to 2018 were counted,and the punishment objects,punishment methods and punishment results were sorted out and analyzed.It is found that under the same punishment basis,the same violations and disciplines have different punishment results,and different behaviors give the same punishment results.Moreover,there is no clear explanation in the punishment decision,which may easily result in the dissatisfaction of the penalty person against the punishment result,and at the same time,it cannot play the role of education and warning for other participants.(3)The reform of sentencing standardization in China and the disciplinary punishment of China Football Association are both to achieve fairness and justice in punishment.Therefore,in view of the improper punishment in the disciplinary punishment of the Chinese Football Association,we can draw lessons from the experience of the standardized reform of sentencing and provide guidance for disciplinary punishment.Firstly,the circumstances of disciplinary penalties imposed by China Football Association should be refined.Secondly,the principle of disciplinary punishment of China Football Association is clarified.Furthermore,we should standardize the penalty measurement methods and improve the relevant mechanism of the disciplinary punishment of the Chinese Football Association.Through research and analysis,the following suggestions are made:(1)To clarify the circumstances of punishment for violations of rules and regulations.Firstly,the specific behavior is classified according to different situations,and the corresponding starting point of measurement and punishment is determined.Second,based on behavioral consequences,severity,social impact and other factors,determine the benchmark penalty for the behavior.Ensuring that light behavior is lightly punished,heavy behavior is severely punished,and peers are punished.(2)Determine the specific scope of the circumstances of lighter and heavier punishment.First,for acts that conform to the circumstances of a lighter or heavier punishment,and according to the factual circumstances of the actor,the applicable scope of punishment is determined.Second,Punishment for violations of rules and regulations adheres to the principle of leniency and strictness,leniency and strictness,and the combination of leniency and strictness.(3)Strengthen the educational principle of punishment.When punishing violations of rules and regulations,in addition to suspending tournaments and imposing fines on the perpetrators,and we should also strengthen the punishment of ideological education and realize the combination of punishment and education.(4)An explanation of the result of the penalty is added to the penalty decision.In the decision of punishment,it is necessary to explain the violation of rules and regulations and the result of punishment,and we should also increase the circumstances of punishment applicable to their acts,how to determine the starting point of punishment,whether it meets the requirements of lighter,heavier punishment and the proportion of adjustment of punishment.
