E-commerce and it's convenience,as well as the characteristics of the low cost attract many consumers to do e-commerce transactions,at the same time,bring challenges to the protection of customers' right.In E-commerce transaction,customers cannot see or touch the products and services within the trading platform,this is clearly different from traditional trading.Transactors have obvious information superiority,leading to customers' weak position be conspicuous.Consumers' right to know as a basic right of consumers is the most vulnerable in e-commerce transactions.Once the consumer's right to know is violated,it will affect other legitimate rights of consumers.This article is divided into four parts,the first part analyzes the characteristics of consumers' right to know in e-commerce through the basic concepts and nature of consumers' right to know.The second part focuses on the current cases of infringement of consumers' right to know in the e-commerce,including: false online advertising,false information and scalping,exploring the reasons why consumers' right to know is often violated,and then exploring the need to protect consumers' right to know in e-commerce.Protecting consumers' right to know in e-commerce is beneficial to balance the information asymmetry between consumers and managers.On the other hand,it helps to protect other legitimate rights of consumers,and ultimately achieves the goal of promoting the healthy development of e-commerce.The third part summarizes and compares the protection of consumers' right to know in e-commerce between the EU and the US,and explores three basic principles in accordance with China's national conditions,that is,the principle of protecting consumers,the principle of consumer protection and social development,and the principle of trade self-discipline.The fourth part proposes specific measures to protect consumers' right to know in e-commerce,first of all,we should improve the information disclosure system,not only to expand the scope of information disclosure by managers,but also to increase the information disclosure obligations of other entities and stipulate legal responsibilities.Secondly,establish a mutual credit evaluation system and a third-party evaluation system.Finally,in the dispute resolution method,online complaints,online arbitration and small claims are used flexibly to provide post relief for consumers with impaired rights.
