Research On The Legal Mechanism Construction Of Electric Vehicle Management In Lhasa

The reason why EV can be seen everywhere in the country become the preferred mode of travel for many citizens,especially those with low and middle income,is that EV have the advantages of lightness,economy,speediness and easy management,which are just incomparable to other means of transport,or can not be combined at the same time.In the view of Zheng Ye fu,a famous sociologist,the rise of electric bicycle can be described as a "miniaturization revolution" in the field of urban transportation in China.[1] Faced with the horn of rapid urbanization in China,the number of urban electric vehicles is increasing with the growth of urban population.While the number of electric vehicles is convenient for citizens to travel,the increasing number also aggravates the problems of traffic congestion,traffic crimes,lithium battery pollution,which are already prominent.Throughout the country,the urban governance problems involving the management of electric vehicles,represented by road traffic accidents,are becoming more and more complex,more and more difficult,and more and more test the wisdom of managers.Lhasa is also among them.Promoting Tibet according to law is an important support for the long-term stability of Tibet Autonomous Region.To deal with the problem of urban governance through the rule of law should be an important measure Lhasa must take in the management of electric vehicles,and the construction of legal mechanism is a necessary prerequisite for the legalization of electric vehicle management.The core idea of this article is to construct a "perfect,feasible,effective,legal and reasonable" legal mechanism to deal with the increasingly prominent management problems of electric vehicles in Lhasa.At present,Lhasa and even the autonomous region have not formulated and promulgated local laws and regulations for the management of electric vehicles,which lag behind other regions in the legislative level.At the same time,Lhasa still has much room to improve the law enforcement of electric vehicle management,especially in the construction of law enforcement team.As a civilized city in China,Lhasa,as a capital city with relatively small population,relatively stable society and relatively relaxed policies,has its own advantages in managing electric vehicles.Before we can draw lessons from the rich and successful experience at home and abroad,there is a way to build the legal mechanism of Lhasa electric vehicle management.The original intention of this article is to help Lhasa clarify its ideas and reach a legal framework in the management of electric vehicles through the construction of legal mechanism and the formulation of specific,micro and interrelated legal measures from the level of local legal system construction in Tibet.This study is based on the geographical scope of Lhasa.The starting point of the problem is the management of electric vehicles in Lhasa.The management of electric vehicles covers many aspects,such as road traffic safety management,production and sales management,registration management,lithium battery recycling,law popularization and safety education.The legal mechanism includes many elements of the operation of the law,including legislation,law enforcement and justice.Among them,legislation,law enforcement,judicial and law popularization of electric vehicle management will be the focus of this paper.In addition,"Lhasa","Electric Vehicle Management","Legal Mechanisms" are not only the constituent elements of the title of this article,but also the key words of the article.Proper understanding and correct interpretation of these three keywords can help readers better understand the article’s intention and deepen their impression of this article.This study mainly adopts the methods of literature survey,comparative study and legal empirical analysis.Through the study,the author believes that Lhasa should strengthen legislation in the management of electric vehicles,formulate clear and feasible laws and regulations;must long-term law enforcement,focusing on the construction of law enforcement team;strengthen the role of judicial undertaking,so that the people can feel fairness and justice in every administrative law enforcement and judicial case involving the management of electric vehicles;deepen law-popularization safety education,will involve.And the compliance and law-abiding behavior of electric vehicle management has risen to a conscious and active universal activity for every citizen.Generally speaking,this paper mainly includes the following sections: The first chapter mainly introduces the academic background and research ideas of this study.The second chapter systematically combs the legal norms of electric vehicle management,including detailed analysis of the legal attributes of electric vehicle and the specific scope of electric vehicle management in Lhasa.The third chapter analyses the current situation,causes and problems of Lhasa electric vehicle management,and summarizes the common and individual problems,regional characteristics and national characteristics of Lhasa electric vehicle management.Chapter IV,through case studies and comparative studies,takes Beijing Regulations on Non-motor Vehicle Management as the blueprint,and combines the national and regional characteristics of Lhasa,makes an analysis of the relevant legal countermeasures.The fifth chapter summarizes the research results of the first four chapters and proposes specific measures and suggestions.
