Recently,with the rapidly development of modern information technology,a series of new technologies and new applications have emerged to change our lifestyle.We enjoy the advantages and opportunities brought about by technological economy.Meanwhile,we are supposed to clearly realize and correctly examine its destructive power and potential risks.As a product of the Internet economy,car-hailing service is changing our trip mode and affecting our daily life.While enjoying the convenience of travel brought by this new mode of operation which based on Internet technology,the vast number of consumers are also suffering from various worries and perplexities.The legitimate rights of net car consumers are frequently damaged due to imperfect in pre-supervision mechanism,in-process safeguard mechanism and relief mechanism afterwards.In order to effectively protect the legitimate rights of net car consumers,we need to improve the prior supervision mechanism,strengthen relevant in-process protection mechanism and perfect the post-event relief mechanism for the protection of consumers’ rights and interests.From the perspective of protecting the legitimate rights and interests of consumers,the article studies the question that how to protect the rights and interests of Chinese online car consumers in the following parts.The introduction part clarifies the background and research significance of the topic selection,combs the research status at home and abroad,and introduces the research ideas and methods.On the basis of expounding the basic connotation and operation mode of the network car,the second part discusses the necessity of protect rights of net car consumer from the perspective of consumer safety rights,right to know,fair trading rights,privacy rights and c aims.The third part discusses the problems of consumer rights protection in Chinese car-hailing operation,mainly including the personal and property safety of consumers is difficult to guarantee,the information that can be known is not sufficient,the access to price service is hard,the personal information is leaked,and after damage,the right to relief is difficult to protect,etc.Afterwards,the reasons for the above problems are analyzed,which mainly because the imperfect supervision mechanism in advance,the lack of in-process protection mechanism,and the incomplete relief mechanism after damage for the protection of consumer rights.The fourth part puts forward specific improvement suggestions for the third part.Firstly,the pre-regulatory mechanism for the protection of consumer rights should be improved,which including establish the supervision between the administrative department and the platform,improve the market access threshold for the car-hailing,and refine the mandatory withdrawal system of the car-hailing market.Secondly,strengthen the protection mechanism for consumer rights protection is significant.In another words,we had better provide travel monitoring,one-button alarm and virtual telephone services for consumers who take the car-hailing.Last but not least,for the protection of consumer rights and interests,improve the after-the-fact relief mechanism,such as improve the complaint system,build a platform to pay compensation system,and improve the insurance system is imminent.Finally,the conclusion part summarizes the above contents and puts forward the unresolved issues about the protection of consumer rights in the car-hailing operation.
