"Intemet+" model has become a new favorite along with the development of the Internet economy;under the overall background of sharing economy,the taxi industry took the lead,thus the era of online taxi booking has been initiated officially.Online car booking optimized the allocation of idle resources and labor,improved the utilization of various resource elements,so that people could enjoy a relatively preferential price,more humanized services,more free choice and faster payment;online car booking is changing our way of traveling and affecting our consumption patterns.There are risks of consumer right and interests infringement during the fast development of online car booking.First of all,the legal status of online car booking’s proprietor is not clear,which may leads to prevarication under the circumstance of consumer infringement;second,the rights to know,privacy,security,rights of claim and free choice of the online car booking’s consumers have the risk of being infringed.Third,supervision and management rigidity of the government departments make it difficult for consumers to claim compensation after being infringed.First of all,this article makes a definition of the legal nature of each subject of the car-hailing-service,so that the affirmation of the main compensation body can be made when the rights and interests of car-hailing-service consumers are damaged.Secondly,it analyzes the existing problems in the car-hailing-service market mainly from the consumer’s point of view,and classifies the cases of damaging consumers’ rights and interests into different types,and explores the causes of these problems.Once again,on the basis of the foreign research on protecting the rights and interests of car-hailing-service consumers,this thesis aims to supplement the research on protecting the rights and interests of car-hailing-service consumers by regulating the market in our country,putting forward the ways to improve and perfect the legal regulations on protecting the rights and interests of car-hailing-service consumers such as,the promotion of cooperation and supervision,the establishment of a sound market access system,a sound credit rating system,the third-party complaint center,a deposit system,insurance benefits,so that the car-hailing-service can be soundly and orderly developed in the socialist market economy.
