On The Contractualization Of Rural Crime Governance

The Northern Song Dynasty "Lv Shi Xiang Yue" is China's first bottom-up by the villagers autonomy,it contains the contractual spirit of Autonomous Township.The "Lv Shi Xiang Yue" relies mainly on moral education,in order to streamline people's hearts and purify social atmosphere,which played an important role in the future development of the rural areas.Township Treaty can be attributed to folk law,soft law category,its governance in the village has a unique advantage.Combine state law and folk law and give play to the advantages of rural autonomy within the framework of law so as to jointly promote the modernization of state governance.This is in line with Xun Zi's idea of combining courtesy and law."Ceremony and law are used together" is the essence of the combination of ruling the country by law and ruling the country by virtues,the purpose is to jointly achieve good governance.Outstanding behavior in rural crime is village cadre corruption and bribery crime,it requires not only state law but also the civil autonomy to govern rural crimes.Liszt said that "the best social policy is the best criminal policy." Therefore,it is especially necessary to improve social policies in criminal governance.However,the paradigm of rural autonomous system in our country has a good effect on rural criminal governance.Criminal governance is a systematic project.We must adhere to the concept of "criminal integration" and uphold the view that "the prevention of crime is better than the punishment of crime".At the same time,crime governance is a crime resistance mechanism in which multiple subjects participate and negotiate.This requires the improvement and development of rural self-governing organizations,the spirit of contract inspired by rural pact to stimulate awareness of villager self-government,meanwhile,with reference to the vision of foreign civil society,we should cultivate the rights awareness of villagers in our country,adhere to the principle of " the combination of morality and governance of rural governance system" for the construction of civil society,citizens laid the foundation for criminal law.This article is divided into four parts.The first part is about the rural specimen of criminal governance and its rural contract.This part points out that it is based on the basic meanings and requirements of criminal governance and rural governance,this paperintroduces the general concepts,meanings,attributes and the contract nature of the rural treaty in our country.The introduction focuses on the emergence and influence of "Lv Shi Xiang Yue".The main body and method of rural governance is the problem of rural governance in this part of the problem,which is divided into the main issues and methods.The second part is the statistics of rural crime governance data.Through statistics of six kinds of authoritative newspapers,Peking University magic weapon,well-known websites of rural crime cases,we analyze the crime of multiple crimes in rural areas,the development trend and so on,summarizing the status quo of crime governance subjects and methods.The third part is the improvement of the rural treaty and the rural crime governance subjects.By analyzing the pluralistic subjects of the countryside,which can be used as a reference to the traditional subjects of rural crime.Starting from the original interpretation of the treaty of "Virtues" and "Faults" in the text of "Lv Shi Xiang Yue",it is better to tap the contractual spirit of the "Township Covenants" and to inspire the improvement of autonomous organizations.The fourth part is the improvement of township and village crime management methods.By analyzing the method of moral education of the country,explaining "etiquettes" and "aid".It is beneficial to improve the methods of rural crime governance through the positive and negative aspects,and it is also beneficial to educate people to do good things.
