Research On Criminal Law Of Cyber Fraud Crime From The Perspective Of Citizen Information Security

With the advancement of science and technology,the Internet has gradually become one of the most important tools for human beings.However,it is like a double-edged knife.On the one hand,it brings us a more convenient way of living,studying,and working.On the other hand,with the widespread application of computer technology,various types of cyber crime cases have gradually increased.In particular,there are many reasons for cyber fraud crimes.The author believes that although personal information security of citizens is one of them,there is a close relationship between the two.At present,China’s research on cyber fraud crimes can be said to be more,but they are only analyzed from a larger perspective or conviction and sentencing perspective.Therefore,from the perspective of protecting the personal information of citizens,the reasons for the repeated prohibition of cyber fraud crimes are further explored,and ways to prevent such crimes are found in order to purify the cyberspace and social peace.This article is mainly divided into three parts,namely the preface,four main chapters,and conclusions.The main contents of the main chapters are:The first part is an overview of cyber fraud crimes.Explore the theoretical controversy of the concept of cyber fraud.Refine the characteristics and types of cyber fraud crimes in related cases.Analyze the relationship between cyber fraud and citizen information security.On the one hand,the dependence of cyber fraud on citizen information is analyzed.On the other hand,it explores the scope of citizens’ personal information infringed in cyber fraud crimes.At the same time,the conclusion is given on the relationship between the two crimes.The second part is to analyze the causes of the criminal rule of law that frequent cyber fraud crimes from the perspective of citizen information security.The content of this part is mainly analyzed from two levels.First,from the criminal legislation,there are still flaws in the protection of personal information of citizens.At the same time,the establishment of a special legal system to protect personal information of citizens is lacking.In the second criminal justice,it is difficult to determine the authenticity of citizens’ personal information and to investigate it.At the same time,there is a lack of effective connection between public security organs and network information management departments.The third part is to evaluate the legal measures adopted by China and foreign countries in cracking down on cyber fraud crimes.Through comparison and conclusion,we still need to improve the legal conclusions of cyber fraud crimes in China.The fourth part proposes legal countermeasures to prevent cyber fraud from the perspective of protecting the personal information of citizens.This part also puts forward suggestions from two aspects.The first is to clarify the right attributes of citizens ’personal information from the criminal legislation level,improve standards with serious circumstances,and establish a legal regulatory system to protect citizens’ information.The second is to comprehensively grasp the authenticity of citizens’ personal information from the perspective of criminal justice,and improve investigation techniques,and at the same time require effective connection of public security organs and network information management departments in their duties.Internet fraud is a new type of fraud crime derived from the information age.The use of personal information of citizens for fraud is the most common method.Netizens not only encounter online scams in the network,but also encounter the issue of personal information leakage.Internet fraud is the act of realizing the purpose of fraud through the manipulation of personal information.The key to preventing online fraud is to ensure the safety of citizens’ information.To borrow the phrase mentioned by the people,"The act of leaking personal information of citizens is an accomplice to cyber fraud".Therefore,to prevent cyber fraud crimes,we need to start with protecting the security of citizens’ information.This article analyzes the types and characteristics of cyber fraud crimes and the relationship between cyber fraud crimes and citizen information security,and explores the shortcomings of criminal law protection in terms of citizen information security.Proposed legal countermeasures to prevent cyber fraud crimes.To effectively crack down on cyber fraud and provide high-quality solutions.
