Research On The Boundary And Protection Mechanism Of The Copyright Of National Folk Music

The mode of copyright protection of traditional folklore and art works has encountered many difficult problems.The innovation of technology provides a new entrance for the protection of traditional folklore and art work.The method of combining technology and copyright provides a breakthrough in the legislation of the special regulations.Not only the mechanism based on big data can provide a unified way of registration and management,but can also simplify the process of morphological analysis of the work through wide areas of data processing."Measures for the protection of copyright in works of folk literature and art shall be established separately by the State Council." as known as Article 6 of the Copright Law of the People’s Republic of China provides a possibility of establishing special regulations for folk literature and art.Though there are legal basis to follow,there are still no efficient ways to prevent folk literature and art works from being infringed.The most important task at present is to establish an effective protection mechanism on the basis of the Copyright Law in order to prevent our music works from being pirated,tampered and misused.This paper attempts to summarize the research status quo of legislating special regulations,elaborate the key points of legislating special regulations in the area of ethnic and folk music and explore the possibility of the "reference protection mechanism" for present ethnic and folk music ecology of our country.
