Research On Government Supervision Of Toll Road PPP Projects In My Country

Since the reform and opening up,China has gradually shifted from the Planned Economy Era to the Market Economy Era in order to meet the requirements of the development for new era.China has explored marketization reform in many fields of public products and services.With the introduction,popularization and development of PPP mode in China,the experience of government supervision in China has been continuously accumulated and the legal systems has been continuously improved.Generally speaking,the government supervision of PPP projects in China has experienced three stages:the initial exploration stage,the mid-term development stage and Current popularization stage.On February 26^th,2015,the Ministry of Transport issued the“Comprehensive Deepening of Transportation Reform Pilot Program”,and the PPP model took the lead in piloting in Zhejiang and Guangdong.On April 20^th,2015,the“Implementation Opinions on Promoting the Use of Governmental and Social Capital Use Models in the Field of Toll Roads”jointly issued by the Ministry of Finance and the Ministry of Transport indicates that China has fully promoted and introduced the PPP model to toll road projects.On December 13^th,2015,the General Office of the Ministry of Transport issued the“Guidelines for the Operation of Toll Road Government and Social Capital Cooperation?Trial?”to regulate the operation process of toll roads and promote the development of toll road PPP projects.Through two-year practice,on November 29^th,2017,the Ministry of Transport issued the“Guidelines for the Operation of Toll Road Government and Social Capital Cooperation”to further standardize the operational procedures and contents of the toll road PPP project.However,due to the complexity of the toll road PPP project,the imperfect legal system,the overlapping of government departments'supervision functions and the lack of experience in government supervision,the PPP project of toll roads has encountered many new problems in actual operation.In order to effectively avoid risks and ensure the maximization of public interest,it becomes a realistic requirement that a unified,standardized and transparent regulatory system should be established.This paper takes the government supervision of China's toll road PPP project as the research object.Through the analysis of the status quo of government supervision of China's toll road PPP project,the author analyzes the existing problems and causes,and summarizes the ways of foreign PPP development in mature national government supervision.Combined with Guidelines for the Operation of Toll Road Government and Social Capital Cooperation which published in November,2017 by the Ministry of Transport,the author finally proposes suggestions and measures to improve the government supervision system of China's toll road PPP project and government supervision at all stages of the life cycle.
