Research On Environmental Liability Insurance System

With the increasing development of industrial production in twenty-first Century,environmental problems have become increasingly serious,environmental pollution accidents occur frequently,so the degree of social concern is also increasing,how solve the environmental pollution brought a series of problems become more important Economic development,especially the balanced development between industrial development and environmental problems,has become the top priority.Some enterprises are prone to pollution problems with high pollution,wide scope and complex tort liability.However,when these serious environmental pollution problems occur,enterprises show the danger of insufficient solvency or even bankruptcy,and many people are infringed but not.To compensate,the government is also forced to bear some serious consequences that should not be borne.The birth of environmental liability insurance system effectively disperses the risk of bankruptcy caused by environmental problems,and better protects the legitimate rights and interests of the victims.In many countries,such as the United States,Britain,France,Germany,Japan and South Korea,this system has been used as a magic weapon to solve environmental problems,and they have started practical activities and put legislative construction on the agendaIn recent years,many scholars in the field of environmental protection have increased their research on the environmental liability insurance system,and many efforts have been made at the national level to promote this work.However,as a whole,there are many problems in the environmental liability insurance system in China.This paper discusses the theoretical basis of this system,the current situation of research and practice at home and abroad,and how to improve our environmental liability insurance system in order to achieve the green development goal of our country.
