The ocean contains more than 70%of oil and gas resources in the world.The development and utilization of offshore oil has become an important part of energy policy in various countries.However,due to the immature technology and imperfect environmental protection legal systems during the development of offshore oil,environmental problems such as increased marine environmental pollution and drastic decline in marine biological resources have occurred frequently.Since the 1980s,China has begun to enter the offshore oil field.However,the environmental pollution cases such as the oil spill from Penglai 19-3 oil field have exposed a number of problems and defects in Chinese marine environmental protection regulations.Based on this,this paper intends to analyze the shortcomings of China’s maritime environmental protection laws and regulations in the process of oil and gas exploration and exploration from the perspective of legislation and enforcement,and to analyze reasons for the problems.Finally,it proposes a systemic approach to improve the environmental regulations for offshore oil development.The first part of the thesis mainly outlines the background of this research and makes a literature review in this special field.The second part mainly summarizes marine pollution caused by the offshore oil development,and concludes the relevant environmental laws and regulations related to Chinese offshore oil development.To be more specific,first of all,the dissertation summarizes the environmental pollution problems occurred in the process of offshore oil development,such as damages to the ocean water body,damages to the atmosphere,and to the marine life.Secondly,the thesis summarizes the relevant laws,regulations,and the main legal instruments in order to prevent and control environmental damages and pollution in the process of offshore oil exploitation.The third part of this thesis analyzes the existing problems in the environmental protection legal system of offshore oil development,including the imperfection of laws and regulations and the imperfection of the legal system.The fourth part analyzes the causes of such problems,including the ineffective use of cost-effectiveness systems,lack of innovation,democracy,and transparency.The fifth part of the thesis elaborates suggestions on perfecting the legal system of pollution prevention and control.Suggestions include emphasizing pollution prevention mechanism,re-establishing environmental standards system,pollution discharge system and optimizing the administrative penalty mechanism,and improving the system of discarding management of the platform.
