The Application Of Risk Prevention Principle In Marine Environmental Protection

With the constant development economy and science and technology, the extent of using and changing nature are deepening. Environmental pollution has become more and more complex, and the level of science and technology is limited, so the science and technology cannot be definite proof of all environmental risks. Traditional environment Protection cannot protect the environment risks which are uncertain, and therefore the precautionary principle arises at the historic moment.This dissertation is comprised of five parts, the first part discuss the basic overview of the precautionary principle, the second part is to describe the characteristics of the precautionary principle in marine environmental protection, the last part will introduce the applying of precautionary principle in China’s Marine environment protection, combining the characteristics of the Chinese marine environment.For the chapter one, first,I will discuss the appearance and development of the precautionary principle. In order to better understand the meaning of the precautionary principle,I will compare the different definition of the precautionary principle,and analysis the core elements of the precautionary principle. Finally, I will discuss the status of the precautionary principle to have more comprehensive and more profound understanding on precautionary principle. The chapter two, I will discuss the procedural norms of precautionary principle. The country’s duty of prior notification and consultation; trans boundary environmental impact assessment.The chapter three is the analysis of the precautionary principle in marine environment protection. For the chapter four, based on the previous two parts and combining the characteristics of China’s marine environment and our country’s specific national conditions, I will discuss and analysis some issues related to the applying of precautionary principle in Chinese marine environment protection. All of these will improve the quality of our country’s marine environment. Thus, China will make a great contribution to the international marine environment protection. The last chapter is the summary of this dissertation.
