As the IT industry is growing at an incredible rate,there is a need to review the existing laws and systems to cope with growing industrial demand and increasing numbers of international data transfer.Trans-border Data Flow(TBDF)not only allows businesses providing IT services including finance,internet,e-commerce to thrive,but also impacts every aspect of our lives which are increasingly dependent on this technology.TBDF is known to have a significant impact on multinational and transnational corporations with respect to international data transfers.But TBDF raises serious questions of privacy protection and restriction of business operation.Many countries around the world are engaging in forms of protectionism to restrict the flow of data across borders,with the most common being regulations.Multinational corporations and organizations doing business in another country must comply with the laws,regulations and systems of the countries in which they operate.Otherwise,they will be fined or punished and these problems can lead to a substantial loss.The scope of personal information collections is expanding from domestic to overseas due to the development of the Internet.Also,when they transfer or exchange information across national boundaries must comply with the agreements or laws and regulations.According to trade statistics of China and South Korea by Ministry of commerce of China,the total imports and exports of South Korea in 2017 reached 280.26 billion US dollars,up 10.9% year on year.Among them,China exported to South Korea amount to 102 billion dollars and imported from South Korea amount to 177 billion dollars.It increased by 9.6% and 11.7% respectively than the same period of last year.Currently,China is South Korea's largest trading partner and South Korea is China's third largest.However,these two countries haven't made an agreement regarding information protection and trans-border data flow.This thesis discusses the definitions of personal information and TBDF and provides descriptions of the personal information protection laws and systems between China and South Korea,and then studies comparison of personal information protection laws and systems in China and South Korea.Also,the paper suggests four ways that Chinese and South Korean companies or organizations can protect citizens' personal information while doing commercial activities on TBDF.Such suggestions are as follows: understanding the personal information protection laws and systems of the relations,the Introduction to the International Security Standards,the balance of the relevant management system in TBDF of personal information and strengthening international cooperation on TBDF.The last part of this thesis is the summary of the research results and conclusion.
