The Study On The Dispute Resolution Institutions Of FIFA

Football is universally considered as the first major sports in the world.It's too far behind to catch up with because of its most audience and participation.The impact and the commercial value of European Five Leagues and the World Cup that even all if other sports can't match because of its deep professionalization degree.There are more than one hundred years of history for the development of professional football.The mature and developed professional leagues has generated a series of disputes on transfer and labor-capital relationship etc.As the management organization of world football,FIFA has established a set of complete disputes resolution institutions.This thesis uses literature review method,case analysis method and comprehensive analysis method to analyze the institutions.The type of disputes resolved by FIFA occurred in professional football,they are international contract and management based disputes.The institutions consist both inside part and outside part.The inside part means that the disputes can be resolved in Players' Status Committee(PSC)and Dispute Resolution Chamber(DRC)of FIFA.The outside part is appeal to CAS.Especially DRC has resolved a large number of disputes in recent years.Governing the Procedures of PSC and DRC stipulates the right of jurisdiction,application of law and rules of procedure of the institutions.Each member country acknowledges and stick up for the FIFA's decisions by signing the FIFA Statutes,this makes the effective of the institution.FIFA indicates that unless there is an independent and justice arbitration court,which is admitted by FIFA,the general court has no jurisdiction of the case.When deciding the case,Status and Transfer Regulation and the relevant regulations of FIFA are the first law resource to be considered,the relevant parties' law and the characteristic of the football are in the second place.Through the analyze of the FIFA disputes resolution institutions,we can find that this institution take effect in each part of the transfer of professional footballer as well as the protection of teenager players,correcting the improper behavior of professional football during its development on time.In addition,FIFA's mature dispute resolution institutions also urge other member federations to adjust their dispute resolution institutions into FIFA's coordinately.This institution is lawful and procedural justice,they are symbol of legalization within the FIFA dispute resolution and plays an important role in the development of international football.
