Research On Disciplinary Sanction System In American Colleges And Universities

In recent years,as college students raise their consciousness of right,the disputes between colleges and universities and the students have frequently arisen from the issue of disciplinary sanction.Influenced by traditional educational concepts,both the administrators and the students in our country have paid insufficient attention to the due procedures and students’ rights.Failing to transform from the concept of"managing students" to "serving students",the university administrators only focus on efficiency while giving less consideration to right and fairness in operating the management system.All these have led to the fact that the colleges and universities only lay emphasis on effectiveness and time sequence but neglect the legality and procedures,and also pay less attention to protect students’ legal rights and interests.As regards for discipline management,American colleges and universities have their own merits that we can learn from.In American colleges and universities,a sound and perfect system with complete procedures has been established,which has specified disciplinary sanction in detail.The school departments perform their own functions,and the students can participate in each link.So to speak,the American disciplinary sanction system for colleges and universities has protected students’rights and interests as far as possible and has realized fairness and justice in disciplinary management,thus playing a key role in ensuring a harmonious campus and improving the quality of higher education.Therefore,to have an in-depth and systematic study of American colleges and universities’ disciplinary sanction procedures and to borrow their successful experiences,not only are beneficial to protect students’ rights and interests,but also are of great significance in creating a favorable atmosphere in colleges and universities.The main framework of the paper is shown as follows.The first chapter is the introduction,including the reason for the research,purpose and significance of the research,concept defining,literature review,research thoughts and research methods.In the second chapter,the development history of disciplinary sanction system inAmerican colleges and universities has been reviewed from the "in loco parentis"period,the transition period to the constitutionalism and contractualism period,which lays a necessary basis for the research on disciplinary sanction in American colleges and universities.The third chapter mainly studies the detailed contents of disciplinary sanction system in American colleges and universities,including the specification and basis for disciplinary sanction,the management organizations,the definition and classification of disciplinary offense,punishment measures,and the students’ rights and obligations in the process of disciplinary sanction.The fourth chapter,combining the regulations on disciplinary sanction in several American colleges and universities and several typical cases,has focused on the specific procedures for academic disciplinary sanction and non-academic disciplinary sanction in American colleges and universities,including the sanction procedures and the remedy procedures.The fifth chapter has summarized the basic features of disciplinary sanction in American colleges and universities,and has analyzed the deficiencies of the disciplinary sanction system in our country’s colleges and universities.Based on this,the author has presented the conception of innovating the student management system in the colleges and universities in our country.It is hoped that the colleges and universities in our country should learn from America’s experience to serve the students with a diversified,open and inclusive mindset so as to push the reform and innovation on disciplinary sanction.
