Study On Student Policy Of University In China

Universities regulate and punish deviated behaviors of students in accordance with Student Policy made by school and it will have direct impacts on students' rights. In recent years, most of educational lawsuits are caused by Student Policy, so the society now pays much attention to it.Using case-study and investigation, the paper not only takes the theory and practice of Student Policy as the research object but also applies Administrative Law theory to explore the legal and conceptual framework of Student Policy. It is also the purpose of this paper to sum up and reveal problems in practice, and finally put forward some suggestions and measures so as to improve practice.In the part of theoretical research, the paper first sums up relative research already done both in and out of the country. Then, by analyzing the relationship in law between universities and students, the paper first proves that Student Policy is the internal regulation on the ground of "special-authority relation" theory, and then sums up the resource of universities' power to make student policy as well as the types and structure of Student Policy.In the part of investigation, by analyzing cases about Student Policies of Universities in China, the paper comes to the following conclusion, that is, there are not only many problems in the process of making Student Policy including the violation of laws and regulations, imbalance between rights and duties, and the pronounced moral color, but also certain defects while carrying out Student Policy. This part also points out that there are imperfections in the two.
