An Inquiryinto The Legal Regulation Of Internet Speech

The cyber police patrol and law enforcement is a new mode of police work launched by China’s public security department,with the goal of safeguarding the national network security and maintaining the Internet public order.The main body targeted by cyber police’s inspection and law enforcement work is a variety of online speech.Now the focus of the cyber police patrol and law enforcement work has shifted to "finding a balance between guaranteeing freedom of speech on the Internet and purifying the network environment" in China.This thesis attempts to explore the feasibility of perfecting the legal regulation of online speech and standardizing network policepatrol and law enforcement work.The thesis includes the following four parts:Chapter one analyzes the current situation and problems of the public patrol and law enforcement work of the cyber police.By elaborating the work objectives,functional positioning,means and measures of the cyber police patrol and law enforcement.This chapter comes to a conclusion that the biggest difficulty of the cyber police work at present is how to achieve the balance between guaranteeing the freedom of speech on the Internet and purifying the network environment.Chapter two studies the characteristics of network speech in the context of cyber police’s public inspection and law enforcement.Through an analysis of the network speech in several typical cases,four characteristics of network speech are obtained.These features demonstrate the urgency of perfecting the legal regulation of online speech.Chapter three investigates the legal regulation of network speech in foreign countries.The United States,Germany and the United Kingdom are selected as examples.This chapter reveals the significance of drawing on the beneficial experience of other countries for our country.Chapter four puts forward suggestions on improving the work of cyber police patrol and law enforcement.This chapter discusses the possibility of strengthening and improving the law enforcement work of online police patrol from three aspects: the legal principles that should be followed to regulate network speech,the specific suggestions for improving the legislation,and the standardization of online police patrol and law enforcement work.It is recommended the cyber police department actively promote the improvement of the legislation on online speech regulation,bring subjective initiative into full play to enhance the level of law enforcement.
