In recent years,with the rapid development of the Internet,social productivity and convenient services such as receiving information,interactive communication,online shopping,multimedia browsing have also been developed.However,it has also become a seminary of crime for criminals,personal extremists and foreign anti-China forces.Due to the virtual nature of the network society,some network users have mistaken the network social activities for moral problems which are not related to the real society.As a result,the behavior of destroying the computer information system,internet fraud,network "sex,gambling and drugs" and online abuse of others case incident,not only makes the network society miasma,but also brings serious harm to the stability of the real society and personal property security.The Ministry of Public Security formally established the "Public Information Network Security Supervision Bureau",and after several years,it has gradually developed into the current network police force,which is now called the "Cyber Police".However,as the Internet is developing so fast,it is necessary to improve the supervision of network security by network police,so that the current network crime cases can be solved timely and effectively.In order to crack down on online crimes and maintain Internet information security,the first batch of weibo,We Chat and baidu tieba accounts is prepared to be centralized online,which are uniformly marked as "Online Inspection and Enforcement" by public security organs from 50 provinces and cities,so that the mode of open inspection and enforcement mechanism of the ministry of public security can be promoted and used in the whole country.However,because of the complexity of the network social participants,the low degree of cooperation between Internet service providers,the widely dispersion of the Internet wrong-oriented public opinions,and many other factors,it also leads to lots of questions such as ambiguous jurisdiction and violation of civil rights,which would reduce the credibility of public security organs as a result.This paper is divided into four parts.The first part is an overview of the Internet police Internet inspection and law enforcement,and it introduces the definition and characteristics,by consulting the information and literature related to the inspection and law enforcement of the Internet police network,and collecting the practical application of this working mode in recent years.The second part introduces details of the effects of warning and criticism education,punishing illegal behaviors,prevention of network crimes,guiding network public opinion,and providing public services by Internet inspection law enforcement.The third part summarizes the problems encountered by Internet police during the inspection and law enforcement,such as imperfect legal basis,unclear law enforcement authority,and nonstandard law enforcement behavior,with the help of the review of the current law enforcement situation according to the relevant cases of online inspection and law enforcement in recent years.The last part combines the experience and lessons of Internet police at home and abroad,and puts forward several reasonable suggestions to further improve the online inspection and law enforcement mode,such as improving laws and regulations by limiting specialized laws and discretion,clarifying the application of jurisdiction,and Innovating law enforcement procedures;Unifying the way of online inspection and law enforcement to establish and perfect the forewarning system,improve the construction of intelligent law-enforcement equipment,and strengthen the building of the Internet police force,as a result to improve the level of enforcement of online inspections.
