The Legal Regulation Of Freedom Of Speech On The Internet In Our Country

As one kind of right,the liberty of speech through internet,gradually emerging under the development of modern technologies and keeping a close connection with people’s ordinary working and life time,is a significant and favorite topic which the current academia makes research on.Naturally speaking,the liberty of speech through internet belongs to the concept of liberty of speech and thus possesses the general characteristics of the latter one.However,due to the virtualization,anonymity and efficiency of internet,the liberty of speech through internet has some special features and negative outcome when enforcement,which contains the infringement of interests of the nation,society and personality.In view of this,we should reconsider and regulate accordingly.The paper starting from the introductions of the definition and Chinese and western research development summarizes the characteristics of the liberty of speech comprehensively and proposes the necessity of legislation on the liberty of speech in both positive and negative views.On a basis of drawing on foreign experience on regulation,the paper,keeping connecting basic principles with specific practice,makes analysis on the current situation and potential issues of legislation on the liberty of speech in China deeply and proposes relevant measures and suggestions from legislative,judicatory,administrative,educating and self-discipline aspects.It comes up with some practical solutions such as establishing the internet court and could provide enlightenment and reference for legislation on the liberty of speech in China.
