Legal Regulation On The Risk Of The Application Of Artificial Intelligence Technology

The development of Internet,Internet of Things,big data technology and economic society has accelerated the industrialization and practicality of Artificial intelligence technology.Artificial intelligence technology plays an important role in promoting human happiness,building democratic politics and achieving sustainable development.It also brings multiple risks.Objectively facing and adopting legal means to regulate various types of risks arising from the application of artificial intelligence technology,and ensuring the sound development and application of artificial intelligence technology will be of great significance to the construction of the rule of law in the intelligent society and the improvement of human well-being.In addition to the introduction and conclusion,this article consists of three main parts:The first part is the risk of using artificial intelligence technology.Firstly,this paper introduces the essence,characteristics and development of AI technology.Then it elaborates on the various risks arising from the application of artificial intelligence technology in intelligent government,intelligent justice and intelligent society.The main risks in intelligent government are the absence of full-automatic administrative act legislation,the weakening of administrative governance ability,the absence of risk prevention and control system and the leakage of citizen privacy.The main risks in intelligent justice are falling into the misunderstanding of "statutory evidence system",lack of sufficient and high-quality judicial data,operation of algorithms by "dark box" and ambiguity of the subject of responsibility in intelligent judicature.Risks in the intelligent society mainly include ethical risks such as human subject status being challenged,data discrimination and security risks such as social order turbulence and public security threats.The second part is about the necessity of legal regulation and legal response to the risk of AI technology application.Firstly,the article explains the necessity of legal regulation on the risk of AI technology application from three aspects: ensuring the development of AI technology is beneficial to human beings,balancing the development of technology and risk prevention,and coordinating the development of legal norms and technological innovation.Secondly,the article puts forward the legal response to the risk of AI technology application,which mainly includes establishing the concept of risk social regulation,constructing multiple risk regulation system and formulating the "virtual and real" dual regulation strategy.The third part is the risk regulation countermeasures for the specific risks arising from the application of AI technology in Chapter one.Specifically,in the intelligent government,we should fill in the legislative vacancy of fully automatic administrative behavior,build a team of professionals of artificial intelligence technology,establish a risk prevention and control system of intelligent government,and improve the privacy protection of citizens' personal data.In the intelligent justice,we should establish judicial personnel evidence examination system,provide sufficient high-quality judicial data,establish algorithmic supervision system,and improve the system of fault imputation in wisdom judicature.In the intelligent society,we should establish ethics-led risk norms,implement the social responsibility of market participants,improve social welfare and security system,and improve public safety protection norms.
