Research On The Implementation Dilemma And Countermeasures Of Vaccine Production Supervision Under The Background Of Vaccine Administration Law

In recent years,the frequent occurrence of problem vaccine cases not only brings great harm to people's health,makes people question the maintenance of the national immune system,affects the implementation of China's immune program,but also is not conducive to the prevention and treatment of major infectious diseases that endanger public safety.At the same time,it also exposed the problem of inadequate vaccine supervision in China.In the process of supervision,the short board of supervision on production link is exposed.In this paper,through the comparison of vaccine regulatory systems at home and abroad,drawing on the advanced experience of foreign countries,and from the perspective of the administrative supervision of vaccine production,the author puts forward suggestions for the legislation and regulatory practice of our country,so as to make up for the lack of administrative supervision of vaccines and improve the vaccine regulatory system of our country.This paper is divided into four parts:First of all,according to the legal provisions of our country,this paper introduces the concept of vaccine and vaccine production administrative supervision,and introduces the current legal system of vaccine production administrative supervision,which is divided into the legislative system of vaccine production administrative supervision and the implementation system of vaccine production supervision.Secondly,analyze the current situation of administrative supervision of vaccine production link in China through problem vaccine events,and analyze the problems of supervision of production link in China's legislation and supervision practice through multi-party data collection.The problems in legislation and supervision are mainly manifested in the lack of specialized operation specifications for vaccine safety production,the lack of implementation rules for supporting systems with administrative supervision,and administrative supervision There are some inherent problems in supervision,such as the imperfection of diversified social co governance pattern,and the problem of supervision information disclosure.Thirdly,it mainly introduces the relevant legal systems of vaccine supervision in different countries.For example,the complete legislation system of the United States,the diversified participation pattern of vaccine regulation,the strict access principle of Japan,the special legislation on vaccine safety and the relevant legislation andregulatory practice experience that other countries should learn from.Finally,in order to further improve the administrative supervision of vaccine production in China,the corresponding countermeasures are put forward based on the study of the problems existing in the legislation and supervision practice in China.
