Problems And Countermeasures Of Community Correction In Yandu District From The Perspective Of Public Management

Different from the traditional penalty of imprisonment and punishment,community correction,as a non custodial and relatively independent penalty execution activity,not only retains the nature of penalty execution,but also highlights the modern penalty concept of "learning from the past and learning from the future,curing the disease and saving the people".At present,the prevalence of community correction in the world is an inevitable choice to improve the efficiency of criminal reform and reduce the cost of justice.It is also an inevitable choice for China to adapt to the global trend of penalty socialization.Since 2003,China has successively carried out the pilot work of community correction in Beijing,Shanghai and other large cities with mature management experience step by step and batch by batch.In2009,the community correction system was comprehensively tried out nationwide.In 2019,the community correction law of the People's Republic of China was formally passed,and the community correction system has shown strong vitality and adaptability in Chinese society.The core of community correction is to put the object of community correction into the society and the community for in-depth transformation,so that it can maintain normal contact with the society,and put an end to the phenomenon of isolation from the world outside the penalty place and disconnection from the society in the imprisonment penalty.This characteristic makes the community correction system must introduce social force except under the strong leadership and supervision of the Party committee and the government and the competent department Volume and market participants.Compared with the western developed countries and East Asian neighbors,China started late in the social forces and market subjects' participation in community correction,and the community foundation was relatively weak.In addition,the penalty concept of society and citizens has not changed,there are various problems in the implementation of community correction.Based on the new public management theory and social governance theory,this paper adopts the combination of case interview and questionnaire survey to fully investigate the current situation of social forces and market subjects participating in community correction in Yandu District,and clarify the current situation of social forces and market subjects participating in community correction in Yandu District.Secondly,through the first-hand data obtained from case interviews andquestionnaires,this paper summarizes the existing problems of social forces and market subjects participating in community correction in Yandu District,and analyzes the causes of the problems from the aspects of awareness,non-governmental organizations and participation basis.Thirdly,through horizontal comparison,analysis and reference,the paper sums up the advanced experience of social forces and market subject participating in community correction in Britain,Japan and Shanghai,and seeks for measures and methods that can be learned and operated.Finally,combined with the actual situation of Yandu District,the optimization path is put forward in order to promote social forces and market participants to participate in community correction and improve the quality of community correction.The ideas put forward are to promote the renewal of ideas,create a good social atmosphere,improve the working mechanism,establish an efficient incentive mechanism,optimize the data enabling,and make good use of the advantages of the market main body.There are 50 references in this paper.
