At present,the frequent events related to academic misconduct in Colleges and universities have repeatedly become hot spots.With the exposure of Zhai Tianlin’s academic misconduct in early 2019,academic misconduct and academic fraud has once again become the focus of social attention.College students,as the reserve talents for work,are the future of the whole society and even the whole country.All sectors of society have high expectations for them.Therefore,the academic misconduct of college students has a unique significance in the whole research field of academic misconduct,and it also an important link in the construction of academic integrity system at this stage.Excessive neglect of academic discipline of highly educated people will shake the authority of higher education and decline the quality of national talents.The construction of the style of study in Colleges and universities is imminent,and the students’ academic moral education is indispensable.In the environment of building the integrity system in the whole society,colleges and universities should play a leading role,strengthen the legal regulation of the students’ academic misconduct,and punish severely those who win false academic achievements by means of false or even plagiarism.The regulation of College Students’ academic misconduct is not only an internal governance problem,but also an important step in the construction of the integrity system.To study the legal regulation of College Students’ academic misconduct,we should first make clear the basic types of College Students’ academic misconduct.Although the specific manifestations of College Students’ academic misconduct are complex and diverse,there are traces to follow classification.Classifying these specific ugly,hidden and negative behaviors will help us to make more reasonable and legal regulation to academic misconduct of college students.The Ministry of education of the People’s Republic of China has successively issued a number of normative documents on academic misconduct in Colleges and universities.For example,from 2014 to 2017,the relevant functional departments of education in China have successively issued a lot of specific procedures and methods,which play an important role in regulating the practice of academic misconduct of college students.From these we can also see the state is determined to govern the behaviors of winning academic status by means of false or even plagiarism.According to the laws and regulations of the state,colleges and universities have formulated specific regulations to evade and punish students’ academic misconduct or violations,andformulated specific regulations to deal with different types and academic related violations.Under the guidance of existing legal norms and internal norms,there are some progress in the practice of College Students’ academic misconduct and other specific behaviors in China.In the regulatory practice,there are also many typical cases,such as Ganlu v.Jinan University,Yu yanru v.Peking University and so on.These cases truly and clearly reflect many problems that need attention in the regulatory practice.In the case,we can also see that in the process of formulating norms,we should not only pay attention to disciplinary measures,but also pay attention to the formulation of relief mechanism.Through the existing domestic colleges and universities students academic misconduct of the legal norms,as well as part of the school norms of the carding analysis.From the standard basis,behavior identification,investigation and handling mechanism,relief measures,etc.We can find out the problems existing in the formulation and implementation of norms in the prevention and treatment of the specific academic misconduct of the highly educated students.Including the lack of procedural norms of academic committees,the absence of moral education,the lack of specific provisions and provisions to effectively reduce and avoid all kinds of academic misconduct or violations of rules and regulations,and the lack of strict punishment measures for violations.Then it puts forward some suggestions on how to realize the pluralistic construction of the subject of regulation,define the standard of academic misconduct,insist on the construction of academic credit mechanism,strengthen the proper guarantee of the accountability procedure,perfect the rational disposition of the subject of responsibility,and perfect the operating mechanism of relief measures.
