Study On The Legal Issues Of Household Registration System And Labor Mobility In China

Laborer flow problems of China’s economic and social sustainable and healthy development has significant influence.The laborers studied in this paper mainly refer to migrant workers who flow between urban and rural areas.China’s unique household registration system has a profound and close impact on the mobility of laborers between rural and urban areas.The separation of urban and rural household registration system and the strategy of heavy industrialization have strengthened the dual economic structure of urban and rural areas in China,and formed a separate labor market between urban and rural areas,which severely restricted the free flow of rural surplus labor force between urban and rural areas.In this paper,literature research,interdisciplinary research and empirical analysis are used.From the perspective of the household registration system,the relationship between the household registration system and the flow of workers in different periods are studied to sort out the existing problems,and then legal regulations and policy Suggestions are proposed to solve the problems.This paper is divided into five parts: The first part is the introduction,illustrating the background and significance of the legal issues of household registration system and labor mobility in China,summarizing the research results of domestic and foreign experts and scholars in this field,and discussing the necessity and importance of studying the legal issues of household registration system and labor mobility.The second part is an overview,which mainly defines the essence and connotation of relevant concepts,introduces the main theories and models of the household registration system and labor mobility issues,and provides the necessary theoretical basis for the following analysis of the relationship between the household registration system and the legal issues of labor mobility in different periods.The third part is the historical evolution of China’s household registration system and laborer mobility.It introduces in detail the household registration system and its reform measures in different periods of China,and analyzes the rights and obligations of the household registration system in different periods in the process of affecting the laborer mobility.The fourth part introduces the problems existing in the flow of laborers in China’s household registration system,such as the absence of laborers’ right of free migration,the lack of guarantee of equal employment right and the existence of residence permit system.The fifth part puts forward some legal regulation Suggestions such as restoring citizens’ right of free movement in the constitution,improving the residence permit system and clarifying the cost sharing of reform in the legislative level.
