A Study On Problem And Resolutions Of ZHU JI Community Correction System In The Implementation

Community correction system is a system which provides supervision,correctional education and financial aids for minor offenders in communities.Judicial administrative organs need to perform duties of supervision and administration,and to offer public services like psychological counseling,skill training programs and employment settlements as well.Carrying out such system and offering public services shows the public administrative function of governments.However,there are some problems while implementing community correction,especially during the process of practical operation.In aspects of public participation,pretrial investigations,supervision,educational aids,rewards and punishments of Zhuji community correction,there are several problems,namely,publics' weak awareness and participation,the flaw of legal environment,the unsound execution system,and the weak construction of organizations and teams.In order to provide powerful supports for executing the community correction in an orderly manner in Zhuji,this paper analyzes reasons from the aspects of value idea,legal conditions,organization constructions and system constructions,and come up with solutions.Firstly,this paper studies the backgrounds and current situations of community correction both at home and abroad,and determines research directions,technical ways and research methods,and defines the concept and nature of community correction.Then,this paper analyzes 6 key parts of executing the community correction via questionnaire survey methods,interviewing methods and case study methods,and founds out that there are issues like low public awareness,weak public participation,unscientific contents of social surveys,ignorance of conclusions,supervision stuff shortages,classified management becoming a mere formality,poor effect of correctional education and financial aids,weak pertinence of correctional programs,the limited degree of assessments,rewards and punishments,inadequacies of deterrence,and so on.By analyzing and summarizing,this paper finds out 4 problems during the process of Zhuji putting community correction into effort.First,there is a lack of understanding in modern penalty ideology and public governance.Second,there are drawbacks in system of pretrial social survey about judicial status,multi-subject judicial status and its duties,and the system of rewards and punishments.Third,team building and multi-subject construction is unsound.Fourth,there are some imperfections about pretrial surveys,classified management and educational aids system.Based on these analysis results and combined with foreign countries' experience of community correction,this paper applies ideas of value guidance,multi-cooperation,and system restriction in new public governance,and it put forwards methods to establish and improve Zhuji's correction system by 4 ways,namely,by strengthening value guidance,improving judicial system,enhancing team building and cultivate multi-subjects,and optimizing implementation system.
