Legal Regulation On Short Video's Copyright Infringement

5G development has entered a fast lane in our country.New technologies are deeply integrated with the content industry,and the user's demand for interactivity and real-time in social,information and other content is becoming stronger and stronger.Users are increasingly demanding interactive and real-time content in social and information aspects.As a new information dissemination medium other than words,sounds,and pictures,short videos quickly occupy a place in the public social due to their rich,vivid,convenient and fast advantages.At the same time,the short video's social and interactive features make its copyright protection face new challenges.As time goes by and market competition intensifies,there is fierce competition between short video producers and broadcasters,and short video infringement cases occur frequently and are related to short videos.The legal disputes have gradually increased.Judicial practice in my country has affirmed the attributes of short videos,and short videos that meet originality can be protected by the Copyright Law.The infringement liability types of short video can be divided into direct infringement and joint infringement.In the legal regulation of direct infringement,on the one hand,the originality determination of short video is disputed,on the other hand,the reasonable use of short video is due to the original System defects lead to unclear boundaries;in the legal regulation of joint torts,it is difficult to determine the tort liability of short video platforms and the platform's duty of care is not yet clear.After sorting out the above problems,using the normative analysis method,comparative analysis method and literature analysis method,on the basis of drawing on the experience of other regions,we propose a plan for copyright infringement of online short video copyrights in China,clarify the legal status of short video copyright,reconstruct the short-term copyright protection boundary,and clarify the principle of blame and the special features of each subject.It is the duty of attention of the short video platform as a network service provider to provide theoretical support for the healthy and orderly prosperity of the short video industry.
