Study On Public Complaints And Proposals In Rural Areas Of Yueqing City

The litigation system is an important way to resolve disputes,protect the rights of the people,and litigation and review procedures.In addition to the court,it is a resource channel that can help others.In the past few decades,China’s petition system has played an important role in social development.It is a unique mechanism for resolving disputes and expressing public opinions.With the continuous development of China’s economy and the continuous changes of social systems,the original distribution of benefits has been eliminated,and conflicts have intensified.These contradictions are mainly concentrated in the grassroots and rural areas.Although government agencies have invested a lot of manpower,material and financial resources,they have little influence,which makes the grassroots government somewhat powerless.In recent years,public complaints and proposals related to prosecution has become increasingly prominent.The phenomenon that people prefer to letter-writing and visiting to believing in the laws has become more prevalent in.And the judicial department has been strongly protested.The issue of complaints involving letters and visits has become a major problem,which judicial authority is faced with.The researchers use the method of binary analysis path to identify the subject and object of rural complaint letters and visits.The reasons for analyzing the existence of petitioners are as follows: unreasonable visits caused by interests,uncoordinated growth of rights protection consciousness and legal consciousness,excessive expectations of the court and excessive dependence on petitions to resolve judicial disputes,and contempt for judicial authority.From the perspectives of the court,some of the judicial officers’ lack of professionalism as well as the decrease of moral level has caused the parties to lose confidence in the justice.In addition,though people in rural Yueqing can complain and propose by letters,calls and network,the complaints have not been solved efficiently and properly due to the decision makers,who have disqualified themselves from that responsibility by showing a woeful grasp of policy related to the complaints.Besides,the number of mediators is not enough at the grass-roots.And they can’t co-operate with each other efficiently.From the causes mentioned above,people in rural area of Yueqing choose letter-writing and visiting to protect their rights instead.Aiming at the problems and causes of complaints and complaints in rural areas of YQ City,the improvement path is proposed from the perspective of letters and visits,courts and social management.For petitioners,we should implement the accountability system for entanglement and visits;improve the construction of social security mechanisms,give priority to the use of social security mechanisms to protect the interests and powers of parties,and use judicial procedures to resolve interest disputes with caution.From the perspective of the court,it is proposed that the authority of the judiciary must be fully established,focusing on judicial openness,judicial fairness,and improving the working standards and professional qualities of judicial staff.From the perspective of social management,it is proposed that the construction of relevant petition systems and the improvement of petition evaluation mechanisms must be accelerated.Actively promote the construction of the work pattern of large letters and visits.
