The Protection Of The Criminal Law Of Children's Rights In Our Country's Incidents Of Child Abuse

Nowadays,more and more incidents of child abuse has been exposed by the Internet media.And there are countless cases of child abuse that have not been revealed in reality.Compared to Adults,there are still many deficiencies in children's ability to protect themselves,and they are more vulnerable to abuse and therefore suffer physical and mental damage,which will have a great negative impact on their personal development.Even some abused children have a psychological shadow,which leads to mental health deficiencies and can become a destabilizing factor in society.Therefore,child abuse should be strictly prevented,controlled and punished,especially should be adequately and specifically provided in the criminal law which was the last line of defense in society.However,in such cases,the protection of children's rights in our current criminal law is not obvious and there are still many shortcomings,which makes children's rights in child abuse of our country can not be effectively guaranteed.It's also partly responsible for the high incidence of child abuse.At this time,it is very necessary to study the protection of the criminal law of children's rights in our country's incidents of child abuse.This is also an inevitable requirement to ensure the healthy growth of children and maintain the legal system.In recent years,our country's media have successively exposed a series of incidents of child abuse,such as the child abuse incident of Wenling,the child abuse incident of XieCheng trusteeship kindergarten,the child abuse incident of RYB kindergarten.The frequent occurrence of child abuse in China has aroused widespread concern.And these incidents of child abuse are typical in China.Therefore,taking such typical child abuse as example,there is also a certain representation to analyze the problems of the protection of the criminal law of children's rights in China's incidents of child abuse.At the same time,using such an example study method can make the problem more intuitively presented to us.This paper is divided into five parts.The first part is the review,analysis and reflection of typical incidents of child abuse in China in the introduction.At the same time,expounds the literature review,research purpose and significance,research methods and research contents of this paper.The second part is to analyzes the reality,necessity and principles of the protection of the criminal law of children's rights in China.The third part is to analyzes the current situation of the protection of children's rights in incidents of child abuse in the current criminal law of our country and points out the shortcomings of the current criminal law in this respect.The fourth part is to make a overseas investigation on the protection of the criminal law of children's rights in the incidents of child abuse,and drawing on the advanced legislative experience of some countries and regions.The fifth part is to put forward measures to improve the protection mechanism of the criminal law for children's rights in incidents of child abuse in China.It is hoped that this can further lead to the in-depth thinking of the relevant legislative departments and the general public,and then increase the protection of the criminal law of children's rights in China's incidents of child abuse,and improve the plight of children's rights in China.
