Study On Issues Of Criminal Law Regulation Of Child Abuse

In the aspect of solving the problem of criminal law regulation of child abuse behavior,China has made corresponding amendments to the prosecution method of the crime of abuse in the form of Criminal Law Amendment,and has expanded the subject scope of the regulation by means of the new added crime of person under guardianship abuse,guardian,which protects the legitimate rights and interests of abused children.However,with the deepening of judicial practice,the above two crimes have exposed some problems to be solved urgently in regulating child abuse behavior,such as the defects of crime setting,limitations of identity crime,improper setting and application of penalty,the limitation of “To be handled only upon complaint” of the crime of abuse,etc.In view of these problems,reviewing the judicial practice in our country,combining with the current disputes of theoretical research,and aiming at effectively preventing and curbing the occurrence of child abuse behaviors,the author believes that the crimes related to child abuse should be integrated,and adding the crime of child abuse in the Criminal Law from the aspects of expanding the scope of the subject,increasing the punishment and publicizing the prosecution mode should be considered,and the criminal law regulation path of child abuse behavior should be explored,so as to better protect the rights and interests of children.
