Legal Research On Supervision Of Shared Accommodation

With the innovation of the shared economy in various fields in China,the shared economy has an important impact on all aspects of the clothing,food,housing and transportation of domestic residents.While the shared economy has made great contributions to society,it also brings great challenges to the supervision of various industries.In the field of shared accommodation in China,due to the lack of regulatory supervision,the development of the industry has been greatly restricted,and the rights and interests of consumers are in a dangerous state.Therefore,it is very important to improve the supervision of shared accommodation.Through literature reading and comparative analysis,this paper finds out the problems existing in the domestic supervision system of shared accommodation,compares the experience of foreign supervision of shared accommodation,and puts forward feasible strategies for improving the supervision system.Firstly,this paper briefly discusses the concept of shared accommodation,the origin and development of shared accommodation,and the current situation of shared accommodation in China.Secondly,through the analysis of the current situation of the supervision of shared accommodation in China,we find the problems in the supervision,including: lack of legal basis for supervision,imperfect supervision content,unclear supervision object and unclear supervision subject.Thirdly,through the comparative study of the regulatory status of shared accommodation in the United States,Germany and Taiwan,China,we can learn useful and feasible regulatory strategies from other countries and regions.Finally,in order to improve the supervision of shared accommodation in China,the following feasible supervision suggestions are put forward to improve the legal system of shared accommodation supervision:clarifying the scope of shared accommodation,formulating unified normative documents to solve the problem of legalization of shared accommodation;perfecting the supervision content of shared accommodation on the basis of defining the supervision objects;perfecting the supervision content of shared accommodation on the basis of protecting both sides of the transaction and improving the lessor and the contract The content of renter’s supervision should focus on strengthening the supervision of operators of e-commerce platforms;improving the setting of supervision subjects: identifying the supervision subjects of shared accommodation,cooperating with the government and industry associations,and giving play to the self-discipline role of industry associations.
