Research On Abnormal Petition

With the constant change of social structure,the rapid development of the productive forces,the interests of increasing progress of continuous adjustment,the people’s thought,the original social contradictions changes,new social problems exposed and subsequently,letters and contradiction with the people of democracy,rule of law,fairness,justice,safety,environment and other aspects of growing demand,and presents the new changes and characteristics."Complaint reporting" medium of the prudent leaders also gradually be organizations and individuals that have ulterior motives to alienation,as some means of petitioners satisfy unreasonable desire,also become leaders in their individual individual will interfere with the system tool,"abnormal petition" as a product of arises at the historic moment,become the important form variation of petitioning activities,produce a series of negative consequences.18 by the fourth plenary session of the party on comprehensively advancing the rule of law "of the central committee of the communist party of certain major issue decision" proposed,"put into the orbit of the handling of complaint reporting,the safeguard legitimate appeal in accordance with the law and the procedure can get the result of the reasonable and lawful",to prevent and deal with non-normal petitioning problem,the complaint reporting under the rule of law,is imminent.In view of the above problems,the author defines the phenomenon of abnormal petitions in detail from the aspects of the nature,characteristics and manifestation of abnormal petitions,conducts a comparative study between ordinary petitions and abnormal petitions,and carefully analyzes the current situation of abnormal petitions and their negative consequences.By studying the non-normal petitioning reflects the legal issues,this paper puts forward the prevention and some effective measures to deal with non-normal petitioning problem of innovative idea: from the drive system under the rule of law,standardization construction and improve the social governance model,constraints,non-normal petitioning behavior three aspects promote the benign development of letters and visits,to resolve social problems brought by the non-normal petitioning behavior,respect and safeguard human rights,and ensure the development of social harmony and stability.
