Research On The Legal Protection Of Personal Privacy In China's Government Data Opening

With the development of informationization and the modernization of national governance system and capability,the construction of e-government is also moving towards government data opening.In order to provide public services,perform social management functions and form government decisions,the government needs to collect a large amount of information as the support of its normal operation,and there must be a large amount of personal information in the information covering different fields.The government shares the data it holds with the society,which inevitably involves the private data that the parties do not want to be disclosed,utilized and disseminated.How to solve the problem of protecting personal privacy in government data opening,balance the interest conflict between the public's right to know and the individual's right to privacy,and provide effective remedy for citizens' right to privacy are the problems that must be considered and solved in the current government data opening.Based on this,in addition to the introduction and conclusion,this paper will be expanded through five chapters:The first chapter is the overview of government data opening.This paper expounds the connotation,principles,standards and life cycle of government data and government data opening,and analyzes the relationship between government data opening and China's existing government information disclosure system.The second chapter is the legal analysis and privacy risk identification of individual privacy protection in government data opening.This paper differentiates and analyzes personal privacy,personal information and personal data,explains the legitimacy of protecting personal privacy in government data opening,discusses the main conflicts between government data opening and personal privacy protection,and analyzes the personal privacy risks in government data opening.The third chapter points out the main problems existing in the protection ofpersonal privacy in the current government data opening in China,that is,the lack of relevant legislation,the lack of perfect government data opening management mechanism,the lack of perfect privacy relief mechanism.The fourth chapter reviews the practice of personal privacy protection in the data opening of foreign governments,and provides a reference for China's personal privacy protection through comparative research.Chapter five puts forward some Suggestions for improving the legal protection of personal privacy in China's government data opening.Through the establishment of special privacy protection law,the standardization of personal information collection procedures,the introduction of privacy management commissioner system and the improvement of personal privacy infringement relief ways,we hope to provide useful reference for the current practice of government data opening.
