Research On The Protection Of Ethnic Rights And Interests

As a multi-ethnic country,national harmony is the prerequisite for ensuring the stability of the overall situation of the country.In 2018,China amended the Constitution.In the preamble of the Constitution,it pointed out that "social ethnic relations of equality,unity,mutual assistance and harmony have been established and will continue to be strengthened",adding the main theme of "harmony" to socialist ethnic relations.National harmony is related to the unification of the country and the stable development of the society.The study of the protection of the rights and interests of the nationality is conducive to safeguarding the interests of all ethnic groups and making the people get along more harmoniously,thus conforming to the requirements of the theme of "harmony".However,at present,China's legislation on the protection of ethnic rights and interests is not perfect,and the legal provisions concerning the rights and interests of ethnic minorities are more general,which makes the nationality rights and interests relief system not complete,and the family rights and interests are not effectively protected when they are infringed.The lack of management departments has led to many problems in the identification and change of ethnic identity.To this end,this paper focuses on the protection of ethnic rights and interests,and studies and analyzes the relevant theories and systems of ethnic rights.Firstly,it analyzes the connotation and attributes of ethnic rights and interests by interpreting the concept and characteristics of ethnic rights.Secondly,it sorts out the legal basis for the protection of ethnic rights and interests,including the protection of minority and minority rights in international human rights law.As well as the contents of the protection of the rights and interests of all ethnic groups in China in the Constitution and related laws.Finally,in view of the shortcomings in the legislative,law enforcement and judicial aspects of the protection of ethnic rights and interests in China at this stage,the legislation on the protection of ethnic rights is proposed in a targeted manner.Effective measures such as setting up a nationality department and improving the nationality rights and interests relief system will make the protection of ethnic rights and interests more scientific and normative,fully protect the rights and interests of all ethnic groups,build a more comprehensive,in-depth and close ethnic relationship,and promote the harmonious development of all ethnic groups in China and the prosperity of the country.
