“Retirement and rehiring” is the main embodiment of retirees playing “remaining heat”.Dealing with the problem of work-related injury protection has far-reaching significance for maintaining social fairness and perfecting the work-related injury insurance system.It is also the key to promoting the Law on the Protection of the Rights and Interests of the Elderly to actively respond to the aging of the population.In practice,why do you frequently retire and return to the employee's employee injury dispute? What is the employment relationship between the companies and the retired reemployed person? What are the employee injury benefits for retired employees after an industrial accident? Etc.Based on these problems,this paper firstly discusses the strong need of the employee's injury protection for the retired retired employees through the macroscopic data analysis,interview data analysis and the literature method combined with the social comparative theory.Secondly,through the literature law and institutional innovation theory,it sorts out the problem of employee injury protection and institutional changes of retired retired employees,and finds that some of its problems are mainly formed in three aspects: First,the current state of the national industrial injury protection system;second,the current state of the retired re-employed staff injury protection policy level of supply;third,the current "religious" social role of retired retired staff on the demand for work injury insurance policy.Afterwards,using the literature method and the actual interview analysis method to access the data and combine the B city research content to obtain the status quo problems that have not been touched in the existing literature.For example,the supply of work injury insurance policy is insufficient,and the implementation is not in place;the statutory retirement age is a stumbling block for the payment of work injury insurance.Based on the interviews and researches,the use of the literature method combined with institutional innovation theory to analyze its problems is due to the lagging supply of industrial injury insurance policies,the “dull” and “distortion” of the statutory retirement age.Finally,using the literature comparison method for the reasons and drawing on foreign experience,a series of feasible countermeasures and suggestions are proposed to effectively protect the workers' rights and interests of retired employees.
