"The law is ten thousand,the first one is safe." As of 2018,China's automobile ownership has reached 327 million,and both production and sales have exceeded 22 million,but the various traffic accidents caused by automobile defects have followed.These defects have already seriously infringed on the legitimate rights and interests of consumers;since consumers are often in a weak position in consumer rights cases,it is necessary to establish a defective car recall system by means of compulsory legislation to protect consumers.To reflect the principle of social responsibility of economic law.China's existing defective car recall system has undergone 15 years of development.Although it has achieved certain achievements,it still has many shortcomings compared with developed countries,such as the lack of the basic law of automobile recall,how to identify defects in automobiles,and How to make the relevant provisions of the Criminal Law directly related to automobile defects,the corresponding provisions on environmental protection,the lack of third-party testing institutions and the contents of defective automobile recall insurance.Based on this,China's defective car recall system is not enough to maximize its due role.Therefore,the author combines the current characteristics of China's defective automobile products,and addresses the problems existing in the current system,and draws on the advanced experience of developed countries,and proposes relevant improvement measures,mainly including the development of special legislation on defective car recalls to expand defective car recalls.The scope and refinement of criminal liability regulations,and the establishment of a sound information collection system and neutral,authoritative third-party testing agencies and other measures to improve China's car recall system;in order to maximize the use of car recall system in protection The role of consumers in their legitimate rights and interests.
