On The Perfection Of China's Rule Of Law Evaluation Index System

The rule of law evaluation has taken more than ten years to take root in China,and has gradually adapted to the soil environment in China.The theoretical guidance and practice on the evaluation of the rule of law from the central government to the local government have sprung up.The Third Plenary Session of the 18 th CPC Central Committee adopted the "Decision on Comprehensively Deepening the Reform of Some Major Issues",emphasizing the establishment of a scientific index system and assessment criteria for the construction of the rule of law should be established.The report of the 19 th CPC National Congress reaffirmed the "three-in-one" and incorporated it into the goal of basic modernization in 2035,emphasizing the combination of formal rule of law and substantive rule of law.The rule of law construction frequently appears in the overall situation.The top-level design document confirms its importance and urgency from the level of national governance,which conforms to the trend of globalization of the rule of law.In recent years,the evaluation activities of the rule of law have been tested in Hangzhou,Beijing and others with relatively developed economic and social levels in the mainland of China.From the selection of the index system to the implementation of the project,it has obvious regional characteristics and is difficult to apply universally.For China's rule of law assessment activities,the local resources based on it in China in the new era are the primary considerations.The system's comprehensive and enforceable rule of law evaluation index system is the guarantee for the implementation of the assessment.The extraterritorial rule of law index practice provides a rich source for China's indicators.For reference,set the indicators for quantitative evaluation,analyze the problems found in the assessment,and achieve the purpose of evaluation.Based on the present situation of China's rule of law development in the new era,this paper explores the direction and improvement path for the perfection of the index system for the construction of rule of law in China by taking the deficiency of the current evaluation index in China as an opportunity.Firstly,from the basic theory of legal evaluation and index system,this paper introduces the social background and practical significance of the legal evaluation practice,the characteristics and functions of the index system.The currentdomestic indicators can be divided into six dimensions: ruling by law,scientific legislation,administration according to law,fair administration of justice,society ruled by law and protection of rights,divided into three levels of indicators,progressive development.Rule of law indicators in Hong Kong,Yuhang,Hebei and other regions System as an example to introduce the domestic more developed areas of the evaluation index exploration.Secondly,it introduces the general situation and existing problems of the evaluation system of rule of law in our country.The data can reflect that the situation of the rule of law has reached a consensus in theory and practice,but the objectivity of the data in the assessment of the rule of law has been questioned.In fact,this is the foundation or source of the evaluation index system construction,it is related to the authenticity and effectiveness of the evaluation of the rule of law.At present,most of the criteria for evaluating the rule of law formulated by many local party committees and governments do not have the attribute of objective measure.Its subjective regulation of a measure index and weight also lacks a certain scientific nature and legitimacy.Due to the difference of concept of original attribute of index,the content of evaluation and the design of index system are influenced by internal and external mechanism to some extent,and the method of weight distribution is too simple and arbitrary.Causes the rule of law index to represent the problem outstanding.Thirdly,this paper introduces the practice of extraterritorial evaluation index system of rule of law,and makes a brief analysis of the evaluation practice of the world's relatively complete and representative "Global Governance Index"(WGI),"Integrity Index"(CPI)and other systems.To provide for the perfection of the index system in our country Learn from.Finally,through the empirical study of the rule of law,the comprehensive evaluation of the local rule of law construction and the special evaluation system of the rule of law index and the key issues in the development are reconsidered.In the concrete design of the index,the homogeneous index of the rule of law is constructed at the national level,the local government has a certain degree of autonomy,and the principle of flexible characteristics is adopted.The combination of interdisciplinary research and qualitative and quantitative analysis adds the credibility and scientificalness of the evaluation of the rule of law.
