Legal Research On The Pension Security Of The Losing Single Child Families

The number of families who have lost their only child has been rising in recent years.In particular,the elderly in the losing single child families lose the family supporting,and there is no other pension security system to protect their pension rights.From the perspective of law.the study on the rights and interests of the losing single child families can provide them with the protection for their elderly life.From the background of family planning policy,this paper analyzes the main reasons for the birth of the losing single child families.The current dilemmas of the losing single child families,including three aspects:no one takes care of daily life,social institutions for the elderly economic capacity is insufficient and the level of Community pension and service is low.Then it analyzes the government responsibility of losing single child families,the government must strengthen the legal consciousness of providing for the aged.At the same time,we found that China’s legislative protection on the pension rights of the losing single child families is non-existent,which leads to loopholes and defects in the implementation of policies and the application of judicial protection.Therefore,the legislature should improve the "population and family planning law" and "the rights and interests of the elderly protection law" as soon as possible.The laws and regulations on the losing single child families’pension security provisions is the premise.At the same time,relevant administrative organs should protect the pension rights and interests of the losing single child families in many aspects.Such as providing a diversified pension model and establishing an old-age insurance system for the losing single child families,promoting the combination of medical care and old-age care,developing community services and reforming the old-age care model for the losing single child families and so on.Finally,Judicial organs should improve the relevant work of judicial protection,expand the scope of the litigation subject and broaden the judicial channels of safeguard the legal rights for the losing single child families.Only the law is clear,can we solve the problem of the losing single child families fundamentally.
