Research On Legal Obligations Of Relevant Subjects In Urban Domestic Waste Classification In China

The experience of developed countries has proved that the classification of municipal solid waste is an inevitable choice to effectively solve the problem of municipal solid waste.To realize the classification of municipal solid waste requires not only citizen participation,management follow-up and technical support,but also the realization of relevant legal obligations to ensure the classification from system to practice.In the classification of municipal solid waste,the ambiguous legal obligations of the participants are an important factor that has been unable to achieve the goal of the classification planning of municipal solid waste in China.Constructing and perfecting the relevant laws and regulations to regulate the legal obligations of the relevant subjects of garbage classification can effectively guarantee the classification of municipal solid waste,realize the recycling of garbage resources,ultimately achieve the reduction of municipal solid waste,resources and harmlessness,and promote the coordinated development of environmental protection and economy and society.Firstly,this paper introduces the legal obligation of the urban domestic waste classification system based on the basic research theory,and then analyses the current status and problems of the legal obligation of the current urban domestic waste classification system at various levels,and puts forward some suggestions.In the introduction part,this paper elaborates the research on the background of MSW classification,and puts forward the purpose,significance,method,framework and goal of this research.The main body is divided into four chapters: The first chapter is an overview of the legal obligations related to the classification system of municipal solid waste,which includes the definition of municipal solid waste,the concept of municipal solid waste classification and related content.In addition,there is a brief description of the legal obligations of the urban domestic waste classification system,mainly including the existing system law of urban domestic waste classification,the legal obligations of the urban domestic waste classificationsystem,which includes the tripartite obligations studied in this paper,namely government obligations,enterprise obligations and community obligations.Chapter II is the study of government obligations in the legal obligations of municipal solid waste classification system.Firstly,the necessity and feasibility of government implementing the legal obligations of municipal solid waste classification system management are put forward,which leads to the legal responsibilities and obligations of the government in the municipal solid waste classification system,mainly including clarifying the technical standards and implementation rules of municipal solid waste classification,and promoting the separation of municipal solid waste.The comprehensive construction of waste disposal facilities,the establishment and improvement of the recycling system of renewable resources,and then analyzed the mechanism of the government to achieve the legal obligations of the domestic waste classification system.Chapter 3 is the study of the corporate obligations in the legal obligations of the urban domestic waste classification system.Firstly,it summarizes the enterprise model of urban waste classification and treatment,then analyses the necessity and feasibility of applying the enterprise model to urban waste treatment,and then conducts the theoretical research on the corporate obligations of the enterprise model of urban domestic waste treatment,in order to lead to the domestic waste treatment enterprises in China.The present situation of enterprise obligation legislation in the model is studied,taking the classification of kitchen waste in Changzhou as an example,and the legislative problems and improvement measures of enterprise obligation fulfillment in the model of municipal waste treatment enterprises are put forward.Chapter IV is the study of community obligations in the legal obligations of municipal solid waste classification system.Firstly,the definition of community and the role of community governance in the system are discussed.Then,based on the content and existing problems of the legal obligations of community solid waste classification,countermeasures are put forward to the dilemma of community legal obligations.Finally,the summary and outlook of the previous paper are given.It is concluded that the implementation of these obligations is of great significance to the classification management of municipal solid waste.
