Freedom of movement as a basic right of citizens is universally recognized and protected in Western countries,and international human rights treaties also incorporate freedom of movement into their protection.However,judging from the development and changes of China’s freedom of movement,citizens’ freedom of movement has not been protected by the Constitution and common law.On the contrary,factors such as the household registration system have been subject to many restrictions.After the 18 th National Congress,the state made a human-centered urbanization strategy deployment,defined the development path of urbanization from the top-level design,deepened the reform of the household registration system,and guaranteed the legitimate rights and interests of the agricultural transfer population urbanization,and successively formulated and implemented A series of policies,such as the “Guidelines for the Reform of the Household Registration System”,“National New Urbanization Planning(2014-2020)”,are behind the deep call for freedom of movement,thus releasing a strong signal to accelerate the urbanization of migrant workers,and implementing and guaranteeing farmers.The freedom of migration of workers has become a key task for China’s comprehensive deepening of reforms.In the attitude of sincerity and truth-seeking,this paper starts to discuss and study on the basis of case analysis and comparative analysis.This thesis consists of four chapters:Chapter one,firstly understands and defines the subject of the paper’s rights,“migrant workers”,and then introduces the connotation of freedom of migration,and combines the two to give it a new connotation under the background of urbanization;secondly,analyze The nature of freedom of migration,which implies that migrant workers are free to migrate,has the right to equality.The essential requirement is to ensure that migrant workers obtain equal opportunities and treatments with the residents who move in the process of urbanization: finally,to ensure the migration of migrant workers.A brief overview of the meaning of freedom.The second chapter analyzes the current situation of migrant workers’ freedom of movement in China.On the one hand,from the perspective of the scale of migration of migrant workers and the rate of urbanization,it isdemonstrated that the development of urbanization has promoted the protection of migration freedom of migrant workers to a certain extent;on the other hand,the freedom of migration of migrant workers during the development of urbanization There are still the following problems,such as the dislocation of freedom of movement and urbanization,the difficulty of settlement due to the system of points and other factors,which has caused migrant workers to limit the freedom of migration because of the short-term benefits of household registration.After the migration of migrant workers,the rights and interests of their children’s education and education have not been effectively implemented and guaranteed.Even the situation of forced migration of migrant workers has often occurred.It is concluded that the migration freedom of migrant workers in China is in an awkward situation.Citizens’ freedom of movement has a long way to go.The third chapter,from the three levels of concept,system and realistic dilemma,analyzes the factors that restrict the freedom of migration of migrant workers,mainly for the following reasons: prejudice against the free migration of migrant workers,lack of equality in the concept of social governance,and constitutional The lack of freedom of movement,the obstruction of the household registration system,and the willingness of migrant workers to settle down are inconsistent with the direction of the country’s overall policy.The fourth chapter puts forward five suggestions on how to effectively protect the freedom of migration of migrant workers: First,clarify the freedom of citizens to migrate,write freedom of migration into the Constitution,and then formulate a special law on freedom of movement;second,promote household registration and Third,scientific planning of urban development,breaking the deadlock of the reality;Fourth,coordinating the balanced development of urban and rural areas,achieving equalization of rights and interests;Fifth,improving the legal relief channels for migrant workers’ freedom of movement,providing the ultimate freedom for migrant workers to migrate.Protective barrier.
