Study On The Legal Problems Of The Disclosure Of Information For Criminal Persons Who Sexual Assault Minors

In order to reduce the incidence of sexual assault on minors,Cixi City,Shanghai and other places adopt the way of publicizing the personal information of sexual offenders and prohibiting them from engaging in specific occupations to prevent crime.The Supreme People’s Procuratorate has sent "No.1 Procuratorial Recommendation" to the Ministry of Education to make suggestions on strengthening campus safety management and preventing crimes against kindergarten children and primary and secondary school students.In addition,the Supreme People’s Procuratorate mentioned in the reform plan that it would establish and improve the information base of sexual assault on minors and the inquiry system of entry into the post,which provided practical ideas and mechanisms for the further implementation of relevant laws and regulations.Aiming at the legal disputes arising in the process of information disclosure of sexual offenders and how to improve and perfect the registration and publicity of sexual offenders’ information,this paper makes relevant discussions and analyses,and puts forward relevant suggestions through learning from the relevant systems of sexual offenders’ records both inside and outside the country.Firstly,this paper discusses the current situation of the research on the disclosure of sexual offenders’ personal information and the related theories at home and abroad;secondly,it analyses the theoretical basis and necessity of the disclosure of sexual offenders’ personal information,and on this basis,it evaluates the problems of legal basis,conflict of rights and values,and specific preventive effect in the process of information disclosure;secondly,it evaluates the problems of domestic and foreign countries.The system of information registration and community announcement of sexual offenders in the United States and South Korea is of great significance to the establishment of relevant systems in our country.Finally,some suggestions are put forward to improve the system.Our country should establish a comprehensive and accurate information registration system of sexual offenders against minors,and carry out conditional and limited information registration system.On this basis,through the establishment of a matching inquiry mechanism and risk assessment mechanism of criminal recidivism,as well as strict rules of deprivation of rights and qualifications,we can build a localized record system of sexual crimes.
