Research On The Prevention And Control Of Domestic Violence In China

The globalization of information is accompanied by the continuous development of mass communication means.Domestic violence against women has gradually entered the public's field of vision,causing widespread concern worldwide.Although the scope and protection of human rights protection against women victims of domestic violence vary from country to country,in general,the protection of the human rights of women victims of violence has been widely recognized by the international community.However,it is sighing that the news of domestic violence against women in China has appeared frequently,and the number of cases of domestic violence against women in our country has increased.At this stage,most of the domestic violence in China is male,and it is characterized by extensiveness,diversity of means,concealment of behavior,and seriousness of consequences.In addition to physical violence and mental violence,domestic violence against women is manifested in economic violence and sexual violence."Sudden violence,silence to break away violence,violence to eliminate violence,and end of violence with life" is a vivid description of women's domestic violence.Women victims in China have suffered both mental and physical attacks in the face of domestic violence,and they cannot be effectively protected by law.Many women who have been victimized have given up their resistance to domestic violence.Family harmony is the foundation of social stability,and thousands of small families are fundamental to social harmony,national progress,and national development.How to effectively protect the rights and interests of women victims and give women a safe and stable family environment is necessary to provide a stable social environment for the people.This article is based on the perspective of female victims.Because female victim groups have different group objects,such as wives and children,and the larger part of domestic violence occurs between spouses,this article is based on the perspective of female victims.Focusing on the group of victimsof this group of wives,by collecting the survey data of major institutions in recent years,the author analyzes the current situation of women suffering from domestic violence,supplemented by empirical evidence,and analyzes the prevention and control of domestic violence from a legal perspective.How to regulate the feasibility measures for China to curb domestic violence against women.This paper is divided into five parts for specific explanation.The first part is mainly a brief overview of domestic violence.This paper analyzes the main body and behavior of domestic violence,and then discusses the meaning of female victims' domestic violence based on the perspective of female victims,and discusses the legal characteristics and types of female victims' domestic violence.The second part is an analysis of the situation of women suffering from domestic violence in our country.On the basis of discussing the meaning of domestic violence of female victims,the data of domestic violence collected by major institutions in recent years are collected,and the female suffers from the number and proportion of women who are violent,and the ways of seeking help from women who are violent.The analysis of the situation of domestic violence provides a powerful reference for raising problems and countermeasures against domestic violence.The third part mainly introduces the causes and harms of domestic violence against women in China.This paper analyzes the causes of domestic violence against women in China from historical and cultural factors,social factors,economic factors and male factors,and recognizes the harm of domestic violence to women and society.The fourth part describes the legal issues in the prevention and control of domestic violence in China.This part analyzes the two aspects of the prevention mechanism and the deficiencies of the relief mechanism.The shortcomings of the prevention mechanism mainly include the lack of awareness of domestic violence by the public and the imperfect mechanism of domestic violence prevention and mediation in China.The deficiencies of the relief mechanism mainly include difficulties in the implementation of personal safety,the need to improve the domesticviolence prosecution system,the burden of proof and the rules of evidence adoption,the absence of female domestic violence relief organizations,and the single relief channels for victims of domestic violence.On the basis of legal issues,the fifth part proposes countermeasures against domestic violence in China.The author believes that the issue of domestic violence should solve the problem of domestic violence against women in China by constructing an anti-domestic violence rule of law education system,a sound prevention and mediation mechanism,a perfect personal safety protection order system,and a domestic violence prevention committee.
