| From the perspective of the current criminal law system in China,the parole system of prisoners belongs to one of the prison penalties in China,which plays a great role in promoting the development of the judicial system in China.The effective implementation of parole system can encourage criminals to reform actively,learn and improve their self-cognition,so as to realize the true meaning of punishment.The implementation of the parole system,from a practical perspective,reduces the actual time of the criminal served and effectively reduces the probability of the criminal once again harming society.The implementation of parole system reflects the scientization,civilization and humanization of punishment,which is in line with the trend of social progress and the new trend of China’s legal society construction.However,many problems and shortcomings have been found in the process of parole system implementation.For example,in China,there are special judicial interpretations for such legal terms as commutation and parole.However,due to various reasons,judicial interpretations are not detailed enough and there are still some unreasonable details.As far as the parole system is concerned,there are many problems such as overly strict conditions of parole and lack of scientific nature of the whole parole procedure.These problems seriously affect the implementation effect of China’s parole system,and it is urgent to be improved and perfected.Based on the problems and perfection of the parole system in China,this paper first introduces the operating background of the parole system and defines its concept and characteristics.Secondly,this paper analyzes the legislation and judicial status of China’s parole system and the problems in its implementation,which mainly include four aspects: unclear conditions of parole application,unreasonable restriction of parole object,imperfect supporting mechanism of parole and imperfect parole revocation procedure.Finally,the author puts forward some countermeasures to improve the parole system in China,including relaxing the applicable conditions of parole,abolishing the proportion limitation of parole,perfecting the supporting mechanism of parole and perfecting the revocation procedure of parole.The in-depth study of the parole systemin this paper is conducive to the timely discovery and improvement of the deficiencies in judicial practice,which has a very effective role in promoting the legal construction in China,as well as further improving the parole system,and realizing the expected role of this system in promoting criminal reform and maintaining social stability. |
