Research On Several Problems Of The Parole System In China

As an important system of penalty execution, the parole system generally used by most countries around the world.It plays an irreplaceable role in stimulating the reform of criminals, urging criminals to return to the society as well as stabilizing the supervision order and saving the cost of supervision in prison. In China, the parole system has also made some development and improvement since it was introduced one hundred years ago.However, due to various reasons, the present situation of application of the parole system in our country is still not optimistic. Both in terms of legislative and judicial, it reveals obvious disadvantages:such as lower applicable rate of the parole system; the relevant legal provisions are general and dispersed; supervision and management mechanism after the parole is far from perfect; the system of parole’s revocation is not perfect; there are many disadvantages in hearing the parole cases, and so on. In response to the above situation and flaws, I run an analysis of the causes of the parole system’s low efficiency, and put forward the idea of the parole system’s perfection in China through combining judicial practice. I hope our parole system can comply with the world trend of the mitigation of penalty execution, the application of the parole system in China is improved and the function of the parole system can give full play.
