Research On Social Forces Participating In Community Correction In Hainan Province From The Perspective Of Social Governance

Community correction is a new way to carry out the education and reform of criminals with all the social resources available in the community,to promote the re-socialization of the criminals,to prevent and reduce the re-offending of the criminals and to prevent and reduce the re-offending of the criminals.Since the trial work began in 2003,community correction has gradually become an important content of the government in the social governance,and it is also the embodiment of the innovation of social governance.The ultimate goal of community correction is to re-socialize the offenders in the community and reduce the recidivism rate,which has the remarkable characteristic of penalty socialization,which determines that the community correction work must have the participation of the social forces.In the practice of community correction at present,due to the lag of legislation,imperfect mechanism,unclear authority of law enforcement agencies and single subject of law enforcement,the participation of social forces is not enough,and the function of correction and education is not obvious.It is necessary for the development of social governance of international tourism island and free trade experimental area to solve the problems existing in the participation of social forces in community correction in Hainan Province and to create a pluralistic pattern of social governance.In the view of social governance,based on the legal practice of community correction and social forces,this paper collects real information through questionnaires,individual interviews and work accumulation,and uses case analysis to summarize the current situation of Hainan Province social forces participating in community correction,and concludes that there is a lack of social force participation,low quality and The reason is that the lack of legislation,the imperfection of the mechanism and the understanding of the concept are different because of the problems such as the lack of stability and the strong administrative color.Through the comparative analysis of the social forces in the United States,Japan,Shanghai,Zhejiang Fengqiao community correction model,from the mature community correction model at home and abroad to draw the essence of the development of social forces to participate in community correction inspiration.Finally,the author puts forward some ideas about how to improve the community correction in Hainan Province from the aspects of perfecting the legal norms of community correction,strengthening the social forces to participate in the construction of community correction mechanism,expanding propaganda and encouraging the policy.
