Research On The Protection Of Financial Consumer's Information Right Under The Background Of Big Data

Under the background of big data,the value of financial consumer's personal information is becoming more and more obvious.Financial institutions exploit financial markets and provide services by collecting and analyzing financial consumer's information.Meanwhile,this also makes the risk of financial consumer's personal information leakage and secondary use greatly increased,and the ability of financial consumers to control their own information is further weakened.Therefore,according to the General Provisions of the Civil Law of the PRC on the right of personal information,the definition of financial consumer's information right in the financial field can enable financial consumers to better protect their information right under the background of big data.This paper starts from the definition of financial consumer's information right and the analysis of legal attributes,along with the thinking of problem analysis,extraterritorial investigation and the protection countermeasures.In addition to the introduction and conclusion,the main body of the paper is divided into four parts:The first part defines and analyses the legal attributes of financial consumer's information right under the background of big data.Firstly,this part clarifies the concept of financial consumer,and then defines financial consumer's information right according to personal information right.On this basis,it elaborates the specific connotation of financial consumer's information right,and analyses the legal attributes of financial consumer's information right.The second part analyses the problems faced by the protection of financial consumer's information right under the background of big data.This part analyses the problems faced by the protection of financial consumer's information right under the background of big data from four aspects: the risk of improper use of financial consumer's information,the technical risk of financial consumer's information,the imperfect internal control mechanism of financial institutions and the lag of financial consumer's information protection rules.The third part investigates and draws lessons from the protection system of foreign financial consumer's information right.This part focuses on the reform and development of the personal information protection system of financial consumers in the European Union and the United States under the background of big data.Through comparative analysis and combined with China's national conditions,it summarizes the legislative models and specific measures that can be used for reference in the protection of financial consumer's information right in the future.The fourth part discusses the countermeasures to protect the financial consumer's information right under the background of big data.Based on the analysis of the problems mentioned above and the enlightenment of overseas investigation to China,this part puts forward the countermeasures for the protection of financial consumer's information right under the background of big data from five aspects: defining the protection path of financial consumer's information right,strengthening the information protection obligation of financial institutions,improving the information supervision system of financial consumers,constructing the multiple relief mechanism of financial consumer's information right,and strengthening the education of financial consumer's information right.
