In the present,the development of live webcast is becoming more and more popular.Because the nature of webcast itself,it is both commercial and news,so it straddles commercial and media sites,has a strong audience and market share.It is widely used beyond ordinary people's imagination,in serious news,the Russian "Star" business cabin and "dawning" main cabin docking event is transmitted to every corner of the world through the live webcast;At the entertainment gala,Madonna's London solo concert was webcast so that tens of thousands of fans could share the moment;in game sports,several major games were broadcast live on the web.For example,World of Warcraft competition,which to a great extent satisfied the game fans,attracted the eyes of many netizens.In addition,the webcast also has a huge number of users.Since 2016,China's Internet live broadcasting industry has also begun to enter the development track,according to data,by June 2016,China,s participation in webcast users has reached 325 million,accounting for 45.8 percent of the total number of Internet users in China.The increase in the number of fans and the popularity of some netizens have turned some live broadcast anchors into "Internet celebrities",but the quality of "Internet celebrities" themselves is different,plus some of them live content is vulgar,and there is the suspicion of accumulating wealth,so It is easy to cause legal problems and arouse hot discussion and thinking in society.In the face of this situation,it is imperative to strengthen the supervision and management of the webcast.This paper is divided into six parts to study the administrative legal supervision of live webcast.The first part is the introduction,introduces the research background and significance of this paper,defines the core concept of this paper,indicates that the main research methods of this paper are literature method,comparative study method and case analysis method;The second part of the network broadcast typical cases and analysis,"Douyu TV to build people","'Li GE'to change the national anthem" two cases were introduced and in-depth analysis,leading to the following webcast process in the process of administrative and legal supervision of the status quo;The third part analyzes the current situation and necessity of administrative legal supervision of webcast,expounds the current situation of administrative legal supervision and supervision system of webcast respectively,and points out the problems existing in administrative legal supervision of webcast,such as the imperfect basis of supervision.The subject of supervision is unreasonable,the content of supervision is not comprehensive,the way of supervision is not scientific and so on.The supervision of the administrative law of webcast can effectively realize the media supervision and promote the healthy development of the live broadcast industry.The fourth part analyzes the current situation of webcast supervision in the United States,South Korea and Germany,and further explains the enlightenment of foreign experience to our country.The fifth part is the suggestion of perfecting the administrative law supervision of the webcast in our country,constructing and perfecting the administrative law and regulation system of the webcast from the aspects of strengthening legislation,perfecting the legislative content and mode,reasonably setting up the subject of supervision and power distribution;Comprehensive coverage of regulatory content,improve classification,quantitative regulatory system.The sixth part is the conclusion and prospect,which summarizes the current situation,problems and countermeasures of the administrative legal supervision of webcast,and further looks forward to it,in order to provide a useful reference for the follow-up research on related aspects.
