Research On The Dilemma And Countermeasures Of Cyber Crime Governance

In the era of globalization and information technology,the Internet has increasingly made the world an indivisible global village and "community of Shared future".Every person can be an information producer and communicator,and information data,goods and services can reach different corners of the world in an instant.The Internet has comprehensively and profoundly affected people's lives.However,the Internet is also a "double-edged sword".While benefiting human beings and facilitating people's lives,it has also brought many new problems to the governance of cyber crimes.The frequent occurrence of cyber crimes poses great challenges to existing rules in the new Internet field.We must increase our participation in the formulation of rules in emerging areas such as the Internet and accelerate the promotion of China's international discourse and rule-making rights in the cyberspace.Cyber crime is a global problem,which cannot be solved by one country alone.The global governance of cyber crime is extremely urgent.This paper has five parts except the introduction part.Firstly,it introduces the meaning of cyber crime,points out the characteristics of cyber crime such as the concealment of means,diversity of motives and global influence,so as to highlight the necessity of cyber crime governance.Secondly,analyze the current situation of cybercrimc governance,including the current situation of cybercrime governance from the perspective of regional organizations and the international perspective.Thirdly,this paper makes a deep analysis of the dilemma of cybercrime governance,and points out the fragmentation of regional legislation,interest orientation and insufficient governance capacity.The content of governance rules in the international perspective lags behind and lacks authority,and the international community still has different views on the "cybercrimc convention".Fourth,put forward solutions to the above difficulties,that is,set up specialized agencies within the region to fight against cybercrime,balance the interests of all parties,and strengthen the improvement of regional governance capacity.In the face of different debates on the cybcrcrimc convention,it is suggested that the model provisions of international cooperation should be established first,and then a new cybercrime convention should be established after the model provisions are mature.In the end,based on China's domestic practice,it is proposed to actively strengthen international cooperation,promote the formulation of model clauses for international cooperation,create a co-governance pattern of cybercrime,accelerate the top-level design of the legal framework for the governance of cybercrime,enhance China's international voice in the field of cyberspace,and build a community of Shared future in cyberspace.
