Research On The Dispute Settlement Mechanism Between China And Korea

With the development of the world economy and areas economy unification,China and Korea as one of the two important economic entities in Asia,their trade and investment ties deeply.China is improving the level of foreign trade at the same time,and also trying to promote regional free trade area construction.China and South Korea government in June 1,2015 signed China-Korea FTA formally and then the China-Korea FTA took effect on December 20.The continued expansion of China’s foreign trade will drive the trade volume between China and South Korea to grow continuously.Due to the rapid increase of trade volume and economic strength,the status of policy and economic between two countries in the Asia-pacific region are improving.However,many problems are exposed,such as trade disputes.These problems not only affect the development of China’s foreign trade,but also restrict the development strategy of China to promote economic integration in northeast Asia.Therefore,on the basis of FTA to perfect the dispute settlement mechanism,it is not only closed to the regional joint work and security,but also helps to promote the construction of free trade area in our country.This paper mainly divides into four parts:The first part is overviews.By introducing the current situation of the development of trade and investment between China and South Korea,explain the main international dispute settlement method,namely political solution and judicial solution.The second part mainly introduces the Korea free-trade agreement in the relevant provisions on the dispute settlement mechanism.And through research,analyze the necessity and feasibility on trade and investment dispute settlement mechanism between China and South.The third part uses the method of comparative analysis,with the a series of international trade dispute settlement mechanism researched,and with bilateral settlement of disputes procedure in the international multilateral trade and investment treaty.Through the comparison and analysis to find the parts,which can be used forreference for the solution of the trade disputes between China and South Korea to provide theoretical support.The fourth part is the focus of this article,that is,by analyzing the Korean free-trade agreement on dispute settlement rules,after a series of dispute settlement theory of comparative analysis.Combining the status quo of bilateral trade and investment between China and Korea,put forward specific reference to perfect the dispute settlement mechanism.
